146 <br /> <br /> Mr. Huja stated that the Planning Commission <br />recommended denial of the rezoning for the following <br />reasons: 1) It is contrary to the Land Use Plan of the <br />Comprehensive Plan~ 2) The rezoning could result in a <br />precedent being set for further rezoning requests for those <br />properties immediately north and west of the site which are <br />vacant or rental residential; and 3) Rezoning of this <br />property and subsequent redevelopment may encourage the <br />destruction of an architecturally unique building. <br /> <br /> Mrs° Gleason made a motion to deny the rezoning, Mr. <br />Barnes seconded, and the rezoning of 2115 Jefferson park <br />Avenue from R-3 to B-2 was denied by the following vote. <br />Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Hall, Mr. <br />Towe. Noes: None. <br /> <br />ORDINANCE: REZONING 2305 ANGUS ROAD FROM R-1 TO R-2 <br /> <br /> Mr. Huja stated that the Planning Commission <br />recommended denial of the rezoning for the following <br />reasons: 1) This area is predominantly single-family in <br />use, character and nature and the rezoning could adversely <br />affect that~ and 2) The rezoning of a single R-2 lot could <br />be deemed a "spot zoning" and would be contrary to good <br />planning practice and state laws. <br /> <br /> Mr. Barnes made a motion to deny the rezoning, Dr. Hall <br />seconded, and the rezoning of 2305 Angus Road from R-1 to <br />R-2 was denied by the following vote. Ayes: Mr. Barnes, <br />Mro Buck, Mrs. Gleason, Dr. Hall, Mr. Towe. Noes: None. <br /> <br />ORDINANCE: <br /> <br />SIDEWALKS <br /> <br />INCREASING STREET CUT FEES AND AMENDING TO INCLUDE <br /> <br /> Mr. O'Connell stated that the ordinance would increase <br />the present fee of $25 to $40 and of $5 to $10 and would <br />include sidewalks, curbs and gutters. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, the <br />ordinance entitled "AN ORDINANCE TO AMEND SECTIONS 24-29.1, <br />25-30.1, 25-30.2, 25-31 AND 25-32.1 OF ARTICLE II OF CHAPTER <br />25 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS <br />AMENDED, RELATING TO EXCAVATIONS IN PUBLIC WAYS" was offered <br />and carried over to the next meeting for consideration. <br /> <br />ORDINANCE: AMENDING PROCUREMENT ORDINANCE <br /> <br /> Mr. O'Connell stated that the ordinance would clarify <br />the current procurement procedures and would update the <br />ordinance to comply with State law. <br /> <br /> On motion by Mrs. Gleason, seconded by Mr. Barnes, the <br />ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />CHAPTER 21.1, PURCHASING, OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, VIRGINIA TO CONFORM THE LOCAL ORDINANCE <br />WITH STATE LAW REQUIREMENTS AND MAKE OTHER HOUSEKEEPING <br />CHANGES" was offered and carried over to the next meeting <br />for consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mrs. Gleason requested that staff look into the matter <br />of trucks parking on sidewalks throughout the City. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, <br />Council unanimously voted to meet in executive session to <br />discuss acquisition of property and legal matters as <br />exempted by Section 2.1-344(a)(2) and (6) of the Virginia <br /> <br /> <br />
