Edwards, seconded by Mr. Vandever, <br />Council made the following appointments to the CSX Property <br />Advisory Committee: Bitsy Waters, Frank Buck, Lloyd Snook, <br />Sidney Rush, Bonnie Smith, David Sheffield, Bill Daggett, <br />Lawrence Burruss, Bob McKee, Kevin Smith, Warren <br />Boeschenstein, Jim Berry, David Beach, Fred Schmidt, Fran <br />Lawrence, and Bob Smith. <br /> <br />STAFF REPORT: CONSIDERATION OF PERMIT PARKING ORDINANCE <br /> <br /> Mr. Hendrix stated that staff had reviewed the Wilbur <br />Smith Parking report to see if it was applicable to the <br />permit parking issue, but staff did not feel that it was. <br />Mr. Hendrix stated that the City Attorney has proposed a new <br />permit parking ordinance and it was recommended that Council <br />hold a public hearing on the matter at the first meeting in <br />September. <br /> <br /> Mr. Clyde Gouldman, City Attorney, stated that the City <br />has successfully used and implemented its permit parking <br />system for approximately 15 years and only changes which <br />were felt to strengthen the ordinance legally were being <br />recommended. Mr. Gouldman stated that other cities with <br />permit parking had also been surveyed. Mr. Gouldman listed <br />the following major recommended changes: 1) Giving Council <br />the final decision on imposing parking restrictions on <br />additional streets; 2) Adding a minimum "commuter vehicle" <br />occupancy requirements to the parking survey. Mr. Gouldman <br />stated that 50% commuter occupancy was proposed, though <br />Council might lower this requirement to 25% commuter <br />occupancy. 3) Streamlining the procedure for creating new <br />parking zones to only an ordinance change by Council after <br />recommendation by the Traffic Engineer with City Manager <br />approval; 4) Adding a definition section to the regulations; <br />and 5) Making the initial petition advisory only to help <br />insulate it from legal challenges. Mr. Gouldman added that <br />Council approval of the proposed ordinance would also ratify <br />the existing parking zones and validate the existing <br />restricted parking areas. Mr. Gouldman recommended that the <br />Clerk publish notice of the public hearing in the newspaper. <br /> <br /> Responding to a question from Mr. Towe, Mr. Gouldman <br />stated that Planning Commission review of the proposed <br />ordinance was not required, though Mr. Huja, Director of <br />Community Development, had been sent a copy of the proposal <br />and asked to comment. <br /> <br /> Mr. Towe requested that neighborhood associations also <br />be sent notice of the public hearing. Mr. Towe made a <br />motion to hold the public hearing on September 6th. Mr. <br />Vandever seconded the motion. <br /> <br /> Responding to a question from Ms. Waters about how <br />commuter vehicles are identified, Mr. Gouldman stated that <br />decals and licenses can be checked, but the easiest method <br />is to have a list of the residents' cars prior to conducting <br />the survey. Mr. Gouldman stated that existing permi% <br />parking areas would not be affected by the new ordinance. <br />Mro Gouldman stated that a survey would be conducted to <br />determine if the parking situation on a particular street is <br />severe and to demonstrate the ~easonableness of Council <br />action. <br /> <br /> Ms. Waters stated that she was concerned that a 50% <br />commuter occupancy rate requirement might be too high. <br /> <br /> Mr. Vandever questioned whether any statistical <br />justification for a certain percentage of commuter vehicles <br /> <br /> <br />
