194 <br /> <br /> Mr. Francis Fife, Vice-President of the Midway Housing <br />Development Corporation, stated that it is hoped that the <br />two houses on Rosser Avenue can be offered at a low rent <br />without a subsidy. <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, <br />the resolution approving VHDA financing for Midway Housing <br />Project was unanimously approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that this Council certifies to the <br />Virginia Housing Development Authority Council's approval of <br />the proposed multi-family residential housing development at <br />216 and 218 Rosser Avenue (Midway Housing Project). <br />Notwithstanding the above, the City will not be responsible <br />for any debt service charges in connection with the aforesaid <br />financing of the multi-family residential housing development <br />at 216 and 218 Rosser Avenue <br /> <br />RESOLUTION: AUTHORIZING CITY ATTORNEY TO FILE SUIT AGAINST <br />INSURANCE COMPANY OF IRELAND <br /> <br /> Mr. Gouldman stated that in 1984 defense costs for two <br />suits against the City amounted to $35,000 and $46,000. At <br />the time the City was insured by the Insurance Company of <br />Ireland who refused to pay the defense costs even though the <br />contract covered such payments. Mr. Gouldman stated that <br />the suit against the Insurance Company of Ireland has been <br />filed and the resolution would ratify that action. <br /> <br /> Responding to a question from Mr. Towe, Mr. Gary <br />O'Connell, Deputy City Manager, stated that the defense <br />costs have been paid out of the City's Risk Management Fund. <br /> <br /> On motion by Rev. Edwards, seconded by Mr. Vandever, <br />the resolution authorizing the City Attorney to file suit <br />against the Insurance Company of Ireland was unanimously <br />approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that two lawsuits filed in June and <br />August, 1988, by the City Attorney in behalf of the City <br />against the Insurance Company of Ireland and other relevant <br />parties are hereby approved and ratified, such suits being <br />filed for the purpose of recovering certain insured <br />litigation costs incurred in defending two separate suits <br />against the City in 1984, 1985, and 1986. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Hendrix stated that the Charlottesville Industrial <br />Development Authority had voted to request that City Council <br />provide part of the funding necessary for a $50,000 storm <br />sewer at Carlton Business Park because of the large amount <br />of money CIDA has had to spend on the clean-up operation. <br />Mr. Hendrix stated that drainage funds could be used for the <br />project, or the CIDA could use funds targeted for the CSX <br />property. <br /> <br /> Mr. Buck stated that he was opposed to providing part <br />of the funding for the storm sewer since that was not <br />included in the agreement with the CIDA concerning Carlton <br />Business Park. Mr. Buck stated that he would reconsider the <br />matter if CIDA funding for the CSX property falls short. <br /> <br /> Mr. Vandever requested more information about the <br />uncommitted drainage funds. <br /> <br />Mr. Hendrix stated that the Council will need to review <br /> <br /> <br />
