218 <br /> <br /> On motion by Rev. Edwards, seConded by Mr. Vandever, the <br />resolution approving the Worker's Comp settlement was <br />unanimously approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia: <br /> <br /> It appearing to. be in the best interests of the City, <br />and it being at the request of our former employee, who is <br />represented by counsel, we hereby approve a lump sum <br />settlement of a workers' compensation claim in the amount of <br />$45,000, less payments made since March 1, 1988, all as <br />agreed between staff and the employee (whose name is not <br />stated here for reasons of confidentiality). The settlement <br />includes our obligation to pay medical expenses for one year <br />from the date the Industrial Commission enters an order <br />approving the settlement. The Director of Finance is hereby <br />authorized to make payment from the Risk Management Fund in <br />accordance with the settlement terms. <br /> <br /> The approval hereby given for the entire settlement is <br />conditioned upon formal approval of the settlement by the <br />Industrial Commission of the State of Virginia. <br /> <br />RESOLUTION: RELEASING DEED OF EASEMENT ON GILLESPIE AVENUE <br /> <br /> Mr. Hendrix stated that this resolution would release an <br /> easement previously granted to the City which is no longer <br /> needed by the City. The releasing of the deed of easement <br /> will clear the title to the property of encumbrances. <br /> <br /> Mr. Hendrix explained that a sidewalk had been planned <br />for the street, but the project was abandoned after property <br />owners objected. <br /> <br /> Ms. Waters recommended that a survey of residents on <br />streets considered for sidewalks be conducted prior to <br />conducting a physical survey for the location of a sidewalk. <br /> <br /> On motion by Mr. Towe, seconded by Rev. Edwards, the <br />resolution releasing the deed of easement on Gillespie Avenue <br />was unanimously approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, that the Mayor is hereby authorized to <br />execute on behalf of the City the following document, in form <br />approved by the City Attorney: <br /> <br />Deed of Release between the City of Charlottesville <br />and Oscar R. and Annie M. Bellomy releasing construction <br />easement, perpetual easement and utility right-of-way <br />on their property at-804 Gillespie Avenue <br /> <br /> A copy of such document shall be kept on file with the <br />minutes of the Council meeting at which this resolution was <br />adopted. <br /> <br />ORDINANCE: EXPANDING PERMIT PARKING ZONE 4 (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND <br /> REORDAINING ARTICLE III OF CHAPTER 16 OF THE CODE OF THE CITY <br /> OF CHARLOTTESVILLE, 1976, AS AMENDED, BY AMENDING SECTION <br /> 16-56.2 RELATING TO PERMIT PARKING ZONES," which was offered <br /> at the September 19th meeting, was approved by the following <br /> vote. Ayes: Mr. Buck, Rev. Edwards, Mr. Towe, Mr. Vandever, <br /> Ms. Waters.
