46 <br /> <br /> WHEREAS, following a joint public hearing before this <br /> Council and the Planning Commission, duly advertised and held <br /> on November 11, 1987, this Council finds that such use will <br /> conform to the standards set forth in Section 31-28.1 of the <br /> City Code and to the criteria applicable to special permits <br /> generally under Chapter 31 of the City Code~ now, therefore <br /> BE IT RESOLVED by the Council of the City of <br /> Charlottesville, Virginia that the special use permit is <br /> hereby granted pursuant to Section 31-28 of the City Cod eto <br /> allow JEM Land Trust to use the property at 1328 Riverdale <br /> Drive for a group home for up to twenty (20) residents. This <br /> property is fuerther identified on City Real Property Tax Map <br /> #50 as Parcel 5, having approximately 170 feet of frontage on <br /> Riverdale Drive, 20 feet of frontage on Ward Place, and <br /> containing approximately 27,966 square feet of land or .642 <br /> acres. <br /> <br /> This special use permit is subject to those conditions <br /> imposed by the Planning Commission at the joint public <br /> hearing. <br /> <br />RESOLUTION: suPPoRTING COVERED-TRUCK LEGISLATION <br /> Mr. Hendrix stated that the Mayor had received a letter <br /> from AAA requesting support for covered-truck legislation by <br /> the General Assembly. Mr. Hendrix~stated that staff was in <br /> favor of such a law and noted that some City trucks would be <br /> included under the legislation. <br /> <br /> On motion by. Dr. Hall, seconded by Mrs. Gleason, <br /> Council unanimously approved the resolution supporting <br /> covered-truck legislation. <br /> <br /> WHEREAS, the transportation of materials such as dirt, <br /> sand, gravel, rocks, garbage or any other material likely to <br /> be blown, dropped, spilled, or leaked onto the public <br /> roadways in trucks which are not covered is hazardous to the <br /> public safety~ and <br /> <br /> WHEREAS, legislation which requires trucks carrying such <br /> materials to be covered would prevent damage to the vehicles <br /> of passing motorists and prevent substantial litter on the <br /> public roadways~ now, therefore <br /> <br /> BE IT RESOLVED that the Council of the City of <br /> Charlottesville, Virginia, requests the General Assembly of <br /> Virginia to enact legislation which would require trucks <br /> transporting such materials to cover the trucks in such a way <br /> that will prevent the materials from being blown, dropped, <br /> spilled or leaked onto the public roadways, with appropriate <br /> exemptions for trucks spreading materials during the course <br /> of snow removal, maintenance or construction of public <br /> roadways. <br /> <br /> ORDINANCE: REGARDING PUBLIC NUISANCE (2nd reading) <br /> <br /> Mr. Buck made a motion to amend the ordinance by <br /> including defecation as well as urination. Mr. Barnes <br /> seconded the motion to amend and the ordinance was <br /> unanimously amended by Council. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING CHAPTER <br /> 17 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS <br /> AMENDED, BY ADDING SECTION 17-23.1 PROHIBITING PUBLIC <br /> URINATION OR DEFECATION," as amended, which was offered at <br /> the meeting of December 7th, was approved by the following <br /> vote.
