Mr. Barnes stated that he would not be in favor of <br />closing the median strip unless additional information <br />warranting the closing was submitted to Council. <br /> <br /> Mro Buck requested that staff provide additional <br />information on the accidents which had occurred in the <br />area. <br /> <br /> Mr. Hendrix stated that the information would be <br />provided to Council and would be placed on the agenda for <br />the December 15th meeting. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT FOR DAY CARE FACILITY AT <br />MCINTIRE SCHOOL BUILDING <br /> <br /> Mr. Huja stated that the Planning Commission had <br />recommended approval for the special permit for the <br />following reasons: 1) It will not have a significant <br />adverse impact on the surrounding neighborhood, and 2) <br />The proposal does not significantly alter the overall use <br />of this facility by the YMCA. This recommendation is <br />conditioned upon the following: 1) The approval be <br />limited to a maximum of 24 children, 2) the use be limited <br />in area and that any expansion would require an amendment <br />to the special permit, and 3) the Phase II plan for the <br />McIntire Village PUD parking be implemented within six <br />months in order to comply with parking requirements. <br /> <br /> On motion by Mr. Barnes, seconded by Mr. Towe, the <br />resolution granting a special permit for a day care <br />facility at the McIntire School Building was unanimously <br />approved by Council. <br /> <br /> WHEREAS, Mr. William B. Daggett, Jr., on behalf of <br />the YMCA, has submitted an application for a special use <br />permit to operate a day care facility in the Old McIntire <br />School Building on 250 Bypass for up to 20 children; and <br /> <br /> WHEREAS, the YMCA was approved as a special permit <br />use in May of 1980 and expanded as part of the McIntire <br />Village Planned Unit Development in December of 1985~ and <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and <br />held on October 14, 1986, this Council finds that such use <br />will conform to the standards set forth in Section <br />31-14(e) of the City Code and to the criteria applicable <br />to special permits generally under Chapter 31 of the City <br />Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that a special use permit is <br />granted pursuant to City Code Section 31-14(e), as <br />amended, to operate a day care facility in the Old <br />McIntire School Building on 250 Bypass, identified on City <br />Real Property Tax Map ~45 as Parcel ~7, having <br />approximately 430 feet of frontage on the 250 Bypass, 570 <br />feet of frontage on Birdwood Road, 590 feet of frontage on <br />Edge Hill Road, 600 feet of frontage on Hillcrest Road and <br />containing approximately 315,500 square feet of land, or <br />7.24 acres. Such special permit shall be subject to the <br />conditions imposed by the city zoning ordinance upon <br />special permits generally, and shall further be subject to <br />the following special conditions: <br /> <br /> (a) That the use be limited to the areas shown in <br />the site plan and that any expansion of the use requires <br />an amendment to the special permit. <br /> <br /> (b) That the Phase II plan for the McIntire Village <br />Planned Unit Development be implemented within six months <br />in order to comply with parking requirements. <br /> <br /> <br />
