end of the year. <br /> <br /> Mr. Claude Cotten, proposed developer of the property, <br />urged Council to grant the rezoning and stated that <br />Albemarle Bank and Trust would have an office on the <br />site should it be rezoned. Mr. Cotten stated that the issue <br />of access to the property from Harris Road would be <br />addressed at the site plan level. <br /> <br /> Dr. Joseph Mooney, speaking as a member of the School <br />Board, stated that he was concerned with the rezoning, <br />especially the potential access from Harris Road because the <br />property is at the entrance to Jackson-Via Elementary School <br />and a residential area. Dr. Mooney stated that he felt <br />rezoning the property would contribute to the stress already <br />felt by the school and neighborhood.. Dr. Mooney recommended <br />that should the rezoning be granted, that a barrier of land <br />be left between the developed property and Harris Road. <br /> <br /> Mro Buck stated that the issue of access must be <br />separated out from the issue of rezoning. <br /> <br /> Mr. Huja stated that staff has been concerned with the <br />access and screening issue, especially as it relates to <br />safety and assured Council that these issues would be <br />considered at the site plan level. <br /> <br /> Mr. Buck stated that he would oppose access to the <br />property from Harris Road, but noted that the proposed <br />developer has worked cooperatively with the City on past <br />projects and was confident that he would continue to do so. <br /> <br /> Mr. Cotten stated that it was his intention to provide <br />fencing and screening. <br /> <br /> Mr. Michael Walsh, representing Fry Springs <br />Neighborhood Association, opposed the rezoning, but stated <br />that he would be agreeable to a B-1 zoning. <br /> <br /> Ms. Josephine Williams of 509-B Harris Road, stated <br />that Harris Road is heavily trafficked and she would oppose <br />access to the property from Harris Road. <br /> <br /> Mr. John Via of Harris Road, stated that he supported <br />the rezoning. <br /> <br /> Mr. Heblich stated that the property in question was a <br />small piece of property adjacent to other commercial <br />property and that it would be inconsistent to not rezone it. <br /> <br /> Mr. Walsh stated that people in the neighborhood were <br />on vacation when the larger piece of property, adjacent to <br />the property now in question, was rezoned and were not aware <br />of the proposed rezoning. <br /> <br /> Mr. Huja noted that staff recommended approval of the <br />property. <br /> <br /> Mr. Cotten noted that the Planning Commission had <br />down-graded the rezoning request from B-3 t° B-2. <br /> <br />ORDINANCE: REZONING PROPERTIES AT SOUTHWEST CORNER OF 5TH <br />STREET, S.W., FROM R-2 TO B-2 <br /> <br /> On motion by Mrs. Gleason, seconded by Mr. Barnes, the <br />ordinance entitled "AN ORDINANCE AMENDING AND REENACTING THE <br />DISTRICT MPA INCORPORATED IN SECTION 31-4 OF THE ZONING <br />ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, BY THE REZONING OF PROPERTY LOCATED AT THE <br />SOUTHWEST CORNER OF FIFTH STREET, S.W. AND HARRIS ROAD" was <br />offered. Mrs. Gleason requested that Council's concerns <br />regarding access and screening be considered during the site <br />plan process. <br /> <br /> <br />
