E." which was
offered at the December 15th meeting, was approved by the
following vote. Ayes: Mr. Barnes, Mr. Buck, Dr. Hall, Mr.
Towe. Noes: None. Absent: Mrs. Gleason.

ORDINANCE: REZONING PROPERTY AT 512 RIVES STREET FROM R-2 TO
B-2 (2nd reading)

Dr. Hall stated that at the previous meeting he had
thought that the rezoning would only affect the expansion of
the existing store, but he was now aware that other uses
could be allowed which would negatively impact the neighbor-
hood and he would vote against the proposed rezoning.

Mr. Towe questioned whether only the location where the
store is situated could be rezoned and whether limitations
could be put on the rezoning.

Mr. Satyendra Huja, Director of Community Development,
stated that only the portion of the property on which the
store is located could be rezoned, but that restrictions
could not be tied in with the rezoning. Mr. Huja noted that
certain issues could be regulated during the site review
process. Mr. Huja stated that a drive-in would not be
allowed with the B-2 zoning.

Mr. Towe questioned whether approval would be required
for parking on the site.

Mr. Huja replied that site plan approval for parking
would be required.

Mr. Barnes stated that while he did not think the
proposed expansion of the existing store would be harmful to
the neighborhood, subsequent uses might be detrimental and
he would oppose the rezoning for that reason.

The ordinance entitled "AN ORDINANCE AMENDING AND
RENENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 OF
THE ZONING ORDINANCE OF THE CODE OF TH ECITY OF
CHARLOTTESVILLE, 1976, BY THE REZONING OF PROPERTY LOCATED
AT 512 RIVES STREET IN THE CITY OF CHARLOTTESVILLE" which
was offered at the December 15th meeting, was denied by the
following vote. Ayes: None. Noes: Mr. Barnes, Mr. Buck,
Dr. Hall, Mr. Towe. Absent: Mrs. Gleason.

ORDINANCE: AUTHORIZING SALE OF LOT ON BUCKINGHAM CIRCLE (TAX MAP
76D, PARCEL 26B)

Mr. Hendrix stated that the sale of property which had
had originally been purchased by the City for water and
sewer reasons, but was now considered surplus property, had
been previously discussed by Council and a contract was now
prepared to finalize the sale.

Ms. Haughey stated that the sale of property had been
advertised and bids received. The sale price was $11,050.

On motion by Mr. Barnes, seconded by Mr. Towe, the
ordinance entitled "AN ORDINANCE TO AUTHORIZE THE SALE OF A
PARCEL OF LAND IN ALBEMARLE COUNTY, IDENTIFIED ON TAX MAP
76D AS PARCEL 26B, TO GUS M. HEILMAN AND ELSIE N.
