140 <br /> <br /> On motion by Mrs. Gleason, seconded by Mr. Towe, the <br />resolution appointing viewers to consider closing Saxton <br />Street was unanimously approved by Council. <br /> <br /> WHEREAS, this Council has received a petition from the <br />Charlottesville Redevelopment and Housing Authority and <br />Jefferson Mall Limited Partnership requesting vacation of <br />Saxton Street; and <br /> <br /> WHEREAS, it appears to Council that the notice required <br />by Section 15.1-364 of the Code of Virginia (1950), as <br />amended, has been duly advertised; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that Ms. Mary Jane Haynes, Messrs. <br />W. J. Copeland and H. P. Winn, Jr. report in writing to <br />Council what inconvenience, if any, would result from such <br />vacation. <br /> <br />ORDINANCE: REZONING NORTHWEST CORNER OF 5TH STREET, S.W. & <br />HARRIS RD. FROM R-2 TO B-1 <br /> <br /> Mr. Barnes stated that he would abstain due to a <br />conflict of interest. <br /> <br /> Mr. Huja stated that the Planning Commission <br />recommended denial of the rezoning request for the <br />following reasons: 1) It is contrary to the Land Use Plan <br />of the Comprehensive Plan; 2) The rezoning could set an <br />unacceptable precedent for further rezoning requests north <br />of Harris Road~ encroaching into the residential area; 3) <br />Sufficient commercially zoned land exists in the area to <br />accommodate the proposed use(s); 4) Traffic problems at <br />this intersection could be further aggravated by increased <br />development that rezoning would permit; 5) The timing is <br />poor for allowing commercial development north of Harris <br />Road; and 6) No pressing public interest is being served <br />whereas many potential negative concerns have been <br />identified by the public. <br /> <br /> Mrs. Gleason stated that she was concerned that the <br />rezoning would generate additional traffic near Jackson <br />Via Elementary School. <br /> <br /> Mrs. Gleason made a motion to deny the rezoning <br />request and Mr. Buck seconded the motion. <br /> <br /> Mr. Towe made a motion to amend the previous motion <br />by deferring action on the rezoning request until the <br />Urban Design Plan is completed. Dr. Hall seconded the <br />motion to amend and the motion was amended by Council, <br />with Mr. Barnes abstaining. <br /> <br /> Council voted to defer action on the rezoning request <br />until the Urban Design Plan is completed, with Mr. Barnes <br />abstaining. <br /> <br />ORDINANCE: RELATING TO RETIREMENT PLAN <br /> <br /> Mr. Hendrix Stated that the ordinance would repeal <br />the mandatory retirement age, would amend the Retirement <br />Plan to make retirement benefits available to permanent <br />part-time employees, and would make certain housekeeping <br />changes. <br /> <br /> Mr. Buck requested cost estimates for expanding the <br />Plan to permanent part-time employees by the second <br />reading of the ordinance. <br /> <br /> Mr. Barnes requested information on what other cities <br />offer retirement benefits to permanent part-time <br />employees. <br /> <br /> <br />
