198 <br /> <br /> On motion by Mr. Barnes,~seconded by Mrs~ Gleason, the <br />resolution authorizing the Mayor to sign a~Consent to <br />Collateral Agreement of Franchise Agreement with SouthernNet <br />of Virginia, Inc. was unanimously approved by Council. <br /> <br />ORDINANCE: RELATING TO CDBG PLANNING PROCESS (2nd reading) <br /> <br /> The ordinance entitled ,AN ORDINANCE TO AMEND CHAPTER 2 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, BY ADDING AN <br />ARTICLE XX, CONTAINING SECTIONS 2-134 THROUGH 2-139 RELATING <br />TO THE COMMUNITY DEVELOPMENT BLOCK GRANT PLANNING PROCESS" <br />which was offered at the April 20th meeting, was approved by <br />the following vote. Ayes: Mr. Barnes, Mr.~ Buck, Mrs. <br />Gleason, Dr. Hall, Mr. Towe. Noes: None. <br /> <br />ORDINANCE: UTILITY RATES <br /> <br /> Mr. Hendrix stated that there had been a further <br /> reduction in gas rates since approval of the FY 87-88 budget <br /> and that the sewer and water rates remained the same as had <br /> been presented at that time. Mr. Hendrix stated that the gas <br /> rates may further fluctuate based on wholesale gas prices in <br /> the future. <br /> <br /> On motion by Mrs. Gleason, seconded by Mr. Towe, the <br />ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION <br />12-3, 12-6, 12-7, 24-2 AND 29-2, AS AMENDED OF THE CODE OF THE <br />CITY OF. CHARLOTTESVILLE, 1976, RELATING TO GAS, WATER AND <br />SEWER CHARGES" was offered and carried over to the next <br />meeting for consideration. <br /> <br />ORDINANCE: CLOSING AN ALLEY OFF PRESTON AVENUE <br /> <br /> This item was deferred until the June 1st meeting. <br /> <br />ORDINANCE: GRANTING TELECOMMUNICATIONS FRANCHISE TO US SPRINT <br /> <br /> Mr. Hendrix stated that~the franchise would allow US <br />Sprint to place cable below certain City streets and noted <br />that the Norfolk Railroad right-of-way was also to be used. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, the <br />ordinance entitled "AN ORDINANCE GRANTING A TELECOMMUNICATIONS <br />FRANCHISE TO US SPRINT COMMUNICATIONS COMPANY, ITS SUCCESSORS <br />AND ASSIGNS TO USE THE STREETS AND OTHER PUBLIC PLACES OF THE <br />CITY OF CHARLOTTESVILLE, VIRGINIA FOR ITS POLES, WIRES, <br />CONDUITS, CABLES AND FIXTURES, FOR A PERIOD OF FIVE (5) YEARS" <br />was offered and carried over to the next meeting for <br />consideration. <br /> <br />ORDINANCE: AMENDING ZONING ORDINANCE <br /> <br /> Mr. Towe questioned how the zoning changes would impact <br />mobile home parks. <br /> <br /> Mr. Huja stated that existing mobile homes would not be <br />affected, but if the mobile home was moved from its present <br />lot, no other mobile home could replace it if the lot was in <br />the flood plain. Mr. Huja stated that 22 sites throughout the <br />City would be affected in this way. Mr. Huja stated that this <br />amendment was in response!to federal safety~requirements and <br />would enable the City to qualify for flood plain insurance. <br /> <br /> Mr. Hendrix stated that trailers in these areas were <br />flooded in 1972 or 1973. <br /> <br /> Responding to a question from Mr. Barnes regarding tree <br />preservation, Mr. Huja stated that some areas previously <br />discussed but not included required additional enabling <br />legislation from the State and areas included in the present <br />ordinance were: protection of trees during construction; <br />removal of trees over 15" in diameter must receive approval by <br /> <br /> <br />
