232 <br /> <br />conditions: 1) The applicant either obtain approval and <br />bear the cost to relocate the infant boy statue or shift the <br />location of the cafe~ 2) The section of the cafe proposed <br />for directly outside the existing restaurant only be allowed <br />after 5:00 p.m. so as not to impede pedestrian traffic; <br />3) The scale of the entrance and waiter station be <br />decreased; 4) The facade of the building in which the <br />restaurant is located should be completed before the cafe is <br />erected; 5) Signage with the cafe must be approved by the <br />DBAR; and 6) Final details of the cafe must be approved by <br />the DBAR. <br /> <br /> Ms. Alison Smith of Daggett and Grigg Architects, <br />stated that the owner of the building is responsible for <br />completing the facade of the building and that work was <br />begun today on the facade. <br /> <br /> Mr. Wiley suggested that completion of the facade <br />of the building become the responsibility of the Coffee <br />Exchange if they wished to receive approval of the cafe. <br /> <br /> Ms. Smith stated that the Coffee Exchange would be <br />willing to relocate the infant boy statue or shift the <br />location. <br /> <br /> Mr. Towe noted that the Nirvana Restaurant which is <br />located in the same block as the Coffee Exchange had <br />indicated an interest in an outdoor cafe. <br /> <br /> Mr. Huja stated that Council had approved a policy <br />which allowed only one cafe per block. Mr. Huja stated that <br />notice had been given to the Nirvana Restaurant that the <br />Coffee Exchange was seeking approval for an outdoor cafe, <br />but he had not heard from them any further. <br /> <br /> Mr. Wiley recommended that in the future property <br />owners on the same block be notified of the pending outdoor <br />cafe application prior to approval by Council. <br /> <br /> Mrs. Gleason moved the resolution authorizing an <br />outdoor cafe for the Coffee Exchange, with the condition <br />that the location of the cafe be shifted and that the infant <br />boy statue not be moved. Mr. Barnes seconded the motion and <br />it was unanimously approved by Council.. <br /> <br /> WHEREAS, the Charlottesville Coffee Exchange, Inc. has <br />applied to City Council for a permit to operate an outdoor <br />cafe on the pedestrian mall~in the 100 block of East Main <br />Street, in connection with the operation of its duly <br />licensed restaurant at 120 East Main Street; and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor <br />cafe is in keeping with the intent of the pedestrian mall, <br />can add significantly to successful commerce in the downtown <br />area, will not unreasonably restrict the movement of <br />pedestrian traffic and will not endanger the public health, <br />safety or welfare; now, therefore, <br /> <br /> BE IT RESOLVED that The Charlottesville Coffee <br />Exchange, Inc. is hereby granted a permit to operate an <br />outdoor cafe on the pedestrian mall in the 100 block of East <br />Main Street, subject to the following conditions and terms: <br /> <br /> 1. The permit shall be valid from its adoption until <br />November 30, 1989, for operation of the cafe during the <br />months of March through November. Not later than November <br />30 of each year, the operator shall remove from public <br />property all furniture and equipment used for such cafe <br />operation. <br /> <br /> 2. The cafe shall be operated only in the areas shown <br />on the drawing prepared by Daggett & Griff Architects, <br />attached as Exhibit A, dated June 30, 1987, and incorporated <br /> <br /> <br />
