Mr. <br />Huja stated that the program is the same as the previous <br />year, and noted that Venable had been dropped as a site last <br />year. <br /> <br /> On motion by Mr. Barnes, seconded by Mrs, Gleason, the <br />$15,238.60 appropriation for the Summer Nutrition Program <br />was offered and carried over to the next meeting for <br />consideration. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT TO SIGMA ALPHA MU FRATERNITY <br />FOR 619 CABELL AVENUE <br /> <br /> Mr. Huja stated that the Sigma Alpha Mu Fraternity had <br />originally submitted a plan to add a party room to the rear <br />of the building, but following concerns by the Planning <br />Commission, the Fraternity had submitted an alternate plan <br />which would put the party room in the basement of the <br />existing building and would only add bathrooms. Mr. Huja <br />stated that the changes had been presented and a public <br />hearing held at the last Planning Commission meeting. Mr. <br />Huja stated that the Planning Commission recommended <br />approval of the special permit for the fOllowing reasons: <br />1) It is in harmony with the Land Use Plan of the <br />Comprehensive Plan~ 2) The proposed development allows for <br />the relocation of party activities to the basement while not <br />increasing the residential occupancy of the house, and 3) <br />The proposed development allows for increase in off-street <br />parking. This approval was conditioned upon the retention <br />of the garage and the side porch. <br /> <br /> Mr. Towe presented Council with pictures he had taken <br />at the Sigma Alpha Mu Fraternity house thesame daywhich <br />showed trash on the porch and in the back of the building, <br />tall grass and a garage cluttered with traffic signs. Mr. <br />Towe recommended that before a~special permit is~granted the <br />Fraternity guarantee that the garage can be used for parking <br />and that assurances are given by the Fraternity that the <br />area will be improved. Mr. Towe stressed that he felt it is <br />important that the City enforce its ordinances since the <br />University will no longer be responsible for the actions of <br />the fraternities. <br /> <br /> Mr. Wiley stated that the City cannot restrict the <br />contents of the garage but can require that the building be <br />improved and accessible for parking. <br /> <br /> Mr. Ron Wiley, an attorney representing Sigma Alpha Mu <br />Fraternity, stated that-the signs have been in the garage <br />since at least 1977~and that he felt that the improvements <br />proposed to the site would encourage the fraternity to <br />improve the negative conditions. Mr. Wiley stated that the <br />fraternity would be agreeable to putting reasonable <br />conditions on the special permit. <br /> <br /> Mr. Roger Wiley recommended that the resolution be <br />deferred so that the specific conditions could be worked out <br />between the City and the applicant. <br /> <br /> Mr. Barnes-stated that he realized that the City cannot <br />require cutting~of the grass and removal of the trash as a <br />condition of the~special permit, ~but would hope that those <br />conditions would be improved in good faith by the <br />fraternity. <br /> <br /> The~resotution was deferred until the next meeting. <br /> <br />RESOLUTION: AUTHORIZING OUTDOOR CAFE FOR COFFEE EXCHANGE, <br />120 E. MAIN STREET <br /> <br /> Mr. Huja stated that the Downtown Board of <br />Architectural Review had reviewed the plans for the proposed <br />cafe and recommended its approval with the following <br /> <br /> <br />
