249 <br /> <br />Council and the Planning Commission, duly advertised and <br />held on June 9, 1987, this Council finds that such use will <br />conform to the standards set forth in Section 31-28.1 of the <br />City Code and to the criteria applicable to special permits <br />generally under Chapter 31 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special use permit is <br />hereby granted to allow the Sigma Alpha Mu fraternity to <br />enlarge the existing fraternity at 619 Cabell Avenue. This <br />property is further identified on City Real Property Tax Map <br />~5 as Parcel 104, having approximately 100 feet of frontage <br />on Cabell Avenue and containing approximately 14,996 square <br />feet of land or .344 acres. <br /> <br /> This special permit shall be conditioned upon <br />completion of improvements to the property in accordance <br />with the site plan approved by the city planning commission, <br />including those additional improvements and repair measures <br />set forth in a letter from Ronald D. Wiley, Jr., counsel <br />for the fraternity, to the Director of Planning and <br />Community Development dated July 14, 1987, which letter is <br />incorporate by reference in this resolution. <br /> <br />RESOLUTION: APPOINTING VIEWERS TO CONSIDER CLOSING A PORTION OF <br />RAILROAD AVENUE <br /> <br /> On motion by Mr. Barnes, seconded by Mrs. Gleason, the <br />resolution appointing viewers to consider closing a portion <br />of Railroad Avenue was unanimously approved by Council. <br /> <br /> WHEREAS, this council has received a petition from <br />James Harvey Miller, David Y. Miller, Pauline M. Leake and <br />Earl C. Leake requesting vacation of a portion of Railroad <br />Avenue adjacent to Parcels 1 and 2 on City Real Property Tax <br />Map 21; <br /> <br /> WHEREAS, it appears to Council that the notice required <br />by Section 15.1-364 of the Code of Virginia (1950), as <br />amended, has been duly advertised; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlotteville, Virginia that Ms. Mary Jane Haynes, Messrs. <br />W. J. Copeland and H. P. Winn, Jr. report in writing to <br />Council what inconvenience, if any, would result from such <br />vacation. <br /> <br />RESOLUTION: ACCEPTING WESTWOOD CIRCLE INTO CITY SYSTEM <br /> <br /> Mr. Hendrix stated that the City Engineer has inspected <br />Westwood Circle and recommended that it be accepted into the <br />City system. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, the <br />resolution accepting Westwood Circle into the City system <br />was approved by the following vote. Ayes: Mr. Buck, Mrs. <br />Gleason, Dr. Hall, Mr. Towe. Noes: None. Abstaining: Mr. <br />Barnes. <br /> <br />RESOLUTION: APPROVING VIRGINIA TRANSIT LIABILITY INSURANCE POOL <br /> Ms. Rita Scott, Director of Finance, stated that the <br /> Virginia Association of Public Transportation Operators is <br /> beginning a self-insurance pool which will provide $1 <br /> million coverage, no liability deductible, minimal <br /> automobile deductible, at a cost of $78,402. Ms. Scott <br /> stated that the Virginia Department of Transportation has <br /> committed ~350,000 for the first year to be used to pay <br /> claims. Ms. Scott stated that the City's maximum liability <br /> would be three times the annual premium. <br /> <br /> Responding to a question from Mr. Towe, Ms. Scott <br />stated that the premium would be paid by Transit and some <br /> <br /> <br />
