136 <br /> <br /> Ms. Slaughter recommended that the strategy regarding school funding be changed to <br />say "up to 40%." <br /> <br />RESOLUTION: ,M:~PROVING SPECIAL PERI;gilT FOR 631 CUTLER LANE <br /> <br /> Mr. Huja explained that the original request from the Montessori School was to include <br />one additional property, but that request has been withdrawn. Mr. Huja said that the <br />Plamfing Commission recommended approval of the special permit for the following reasons: <br />1) The proposed use will not have an undue adverse impact on the surrounding <br />neighborhood, if conditions are met; and 2) The proposed school would be in harmony with <br />the provisions of special permits in R-I zones, which is substantially in accord with the intent <br />of the Comprehensive Plan. <br /> <br /> Ms. Daugherty asked Mr. Huja if staff`follow up to ensure that conditions of special <br />permits are met, and Mr. Huja replied that they do. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Daugherty, the special permit for 631 <br />Cutler Lane was unanimously approved by Council. <br /> <br /> WHEREAS, the Montessori School of Charlottesville, owner of the property <br />designated as 631 Cutler Lane, and lessee of property at 1200 Park Street (Park Street <br />Christian Church), has requested a special use permit to expand the approved enrollment of <br />students from 30 to 57 students at 63 t Cutler Lane, and to reduce the number of students <br />from 35 to 30 at the 1200 Park Street location. This property is further identified on City <br />Real property Tax Map #47 as Parcels 2 and 2.12 having approximately 72 and 430 feet of <br />frontage on Cutler Lane, respectively, additional frontage on Park Street, and containing <br />approximately 10,800 square feet of land or .26 acres, and 348,480 square feet of land or .8 <br />acres, respectively; <br /> <br /> WHEREAS, following a joint public heating before this Council and the Plarming <br />Commission, duly advertised and held on December 9, 1997, this Council finds that such use <br />will conform to the criteria applicable to special permits generally under Chapter 34 of the <br />City Code; now, therefore <br /> <br /> BE IT RESOLVED by the COuncil of the Cky of Charlottesville, Virginia that an <br />amendment to the special use permit granted on May 3, 1976, is hereby approved and <br />granted to The Montessori School of Charlottesville, owner of the property at 631 Cutler <br />Lane and lessee of property at 1200 Park Street, to expand the school's total enrollment of <br />students to 87. This approval is conditioned upon the following: <br /> <br />(1) That the school enrollment in both locations be limited to 87 students with no more <br /> than 57 students at 631 Cutler Lane and 30 students at 1200 Park Street. <br /> <br />(2) That the site plan be amended and approved with the following additions: <br /> <br />(a) New opaque screen fencing at least 8' tall with evergreen trees supplementing this <br /> be installed along the rear and east side of the playground area at 631 Cutler Lane by <br /> the end of May 1998. <br /> <br />(3) That the school inform parents at the start of each school term that they should use <br /> Cutler Lane for access to and from the school and utilize car pools where feasible. A <br /> copy of the school enrollment list and of this written notice shall be provided to the <br /> Department of Community Development each year. <br /> <br />(4) That the school continue to develop parking alternatives for the school-wide events <br /> during the year which involve students and parents, without adversely impacting the <br /> neighborhood streets. <br /> <br /> <br />
