137 <br /> <br />RESOLUTION: APPROVING SPECIAL PERMIT FOR 1512 E. MARKET STREET <br /> <br /> Mr. Huja explained that the facility owned by Jefferson Area Board for Aging (JABA) <br />was previously a 40-person adult care center and now is proposed to be a senior center for <br />up to 100 participants. Mr. Huja noted that expansion of the facility would have a financial <br />impact on the City in that JABA wilt likely request additional funding to operate the facility <br />which will replace the current program operating at Carver Recreation Center. ]?vk. Huja said <br />that the Planning Commission recommended approval of the special permit because the <br />proposed use will not have an undue adverse impact on the surrounding neighborhood, if <br />conditions are met. <br /> <br /> Ms. Slaughter noted that approval of the special permit will not automatically increase <br />City funding. <br /> <br /> Ms. Linda Peacock, Assistant City Manager, explained that in FY 99 the JABA Senior <br />Center will cost $13,600 more than currently allocated to the Carver site, and staff projects a <br />total annual cost to the Cky of $52,000 in FY 2000, more than twice the amount currently <br />allocated in support of the Carver site. <br /> <br /> Responding to a question from Mr. Toscano, Ms. Peacock said that the Carver site will <br />continue to be used for recreation space. <br /> <br /> Mr. Toscano made a motion to approve the special permit and Ms. Richards seconded <br />the motion. <br /> <br /> h/fi-. Clyde Gouldman, City Attorney, recommended that conditions 3 and 4 be <br />combined, and noted that as written, up to 99 participants would be allowed four times on <br />weekends and evenings, and the restriction to only one evening would apply to 100 <br />applicants. <br /> <br />Mr. Toscano and Ms. Richards amended their motion to combine conditions 3 and 4. <br /> <br /> The special permit for 1512 E. Market Street, as amended, was unanimously approved <br />by Council. <br /> <br /> WHEREAS, Jefferson Area Board for Aging, agent for the owner (Burgess Lane <br />Properties, Inc.) of the property at 1512 East Market Street has requested an amendment to <br />the special use permit granted on June 5, 1989 (and amended January 19, 1993 and March 1, <br />1993) to change the use of the property located at 1512 East Market Street from an adult da;y, <br />care center to a Senior Center. This property is further identified on City Real Property Tax <br />Map 56 as a portion of Parcel 40.4, having approximately 154.6 feet of frontage on East <br />Market Street, and containing approximately 100,188 square feet of land or 2.3 acres; <br /> <br /> WltEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on December 9, 1997, this Council finds that such use <br />will conform to the criteria applicable to special permits generally under Chapter 34 of the <br />City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that an <br />amendment to the special use permit is hereby approved and granted to Jefferson Area Board <br />for the Aging, agent for the owner of the property at 1512 East Market Street, to change the <br />use of the property from an adult day care center to a private non-commercial recreational <br />facility for group use (senior center). This approval is conditioned upon the following: <br /> <br />(1) That the facility be limited to no more than 100 members using this location at any <br /> given time. <br />(2) That the facility be used for the Senior Center only. <br />(3) That the number ofweeknight and weekend actix4ties be limited to four (4) events per <br /> month, only one of which may have the maximum participation of 100 members. <br /> <br /> <br />
