160 <br /> <br /> Mr. Toscano made a motion to delete the Peyton Pontiac building from the list of <br />contributing buildings because of the extensive alterations, lvlr. Toscano said that this will <br />allow a potential developer to save all or part of the building, or replace it entirely with a new <br />building: Ms. Richards seconded the motion. <br /> <br /> The Peyton Pontiac building was unanimously removed from the list of contributing <br />buildings. <br /> <br /> Mr. Toscano made a motion to remove Stacy Hall as contributing because it is not 50 <br />years old and has been extensively renovated. Mr. Cox seconded the motion, adding that <br />there may be some higher and better use for that building in the future. <br /> <br />Stacy Hall was unanimously removed from the list of contributing buildings. <br /> <br /> Mr. Cox made a motion to approve chapters 1, 3, 4, and 7 of the design guidelines, <br />with the amendments made by Mr. Gouldman. Ms. Slaughter seconded the motion. <br /> <br /> Mr. Toscano asked if the BAR has seen Mr. Gouldman's changes regarding demolition <br />and removal of non-contributing structures, and Mr. Higgins said that the BAR was sent the <br />changes last week. <br /> <br /> Ms. Slaughter noted that the Chair of the Urban Design Committee has also seen the <br />changes recommended by Mr. Gouldman. <br /> <br /> Mr. Toscano asked what is "reasonable justification," and Mr. Gouldman said that <br />demolition would be allowed unless the determination is made that the non-contributing <br />designation was wrong. <br /> <br /> Ms. Richards asked if suggestions for new construction in Chapter 4 are used as rigid <br />requirements or useful guidelines, and Mr. Higgins replied that they are used as useful <br />guidelines to prepare applications. <br /> <br /> Mr. Toscano recommended that Council's understanding that the guidelines are not <br />rigid requirements be conveyed to the BAR by letter to address Ms. Richards' concern. <br /> <br /> Mr. Gouldman explained that Public Works has some concern with the cost of public <br />improvements under the guidelines and recommended that Chapter 6 be discussed further by <br />staff and the BAR. <br /> <br /> Mr. Cox amended his original motion to include approval of chapters 2 and 5, with <br />changes recommended by Mr. Gouldman, and Ms. Slaughter approved the amendment. <br /> <br /> Chapter 1, 2, 3, 4, 5, and 7, as amended by Mr. Gouldman, were unanimously approved <br />by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that <br />Chapters 1, 3, 4 and 7 of the proposed Historic District Design Guidelines, as amended, are <br />hereby approved. Said Guidelines and the amendments are attached hereto and made a part <br />of this resolution. <br /> <br />PUBLIC HEARING: APPROVING TENANT LEASE - PEN PARK HOUSE <br />RESOLUTION <br /> <br />Ms. Richards said she feels that the lease is a good arrangement. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing was <br />closed. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Daugherty, the resolution approving ~the <br />tenant lease for the Pen Park House was unanimously approved by Council. <br /> <br /> <br />
