242 <br /> <br /> Ms. Emily Heule, Riverside Avenue, said that she is a low income resident of the <br />City and the current rates of the City pools impact her quality of life. Ms. Heule noted <br />that the Mclntire wading pool is no longer free and asked that Council find a way to <br />allow low-income families to swim next summer. <br /> <br /> Ms. Nancy Hurrelbrinck, 1020 St. Clair Avenue, said that she is saddened by the <br />tone of people addressing City Council and is embarrassed that she came to the last <br />meeting without adequate information about statements reportedly made by Ms. <br />Daugherty and Ms. Richards. Ms. Hurrelbrinck said she now knows that the statements <br />were taken out of context. Ms. Hurrelbrinck said she feels the community needs to work <br />together and support Council. <br /> <br /> h/k. Kevin Lynch said that he looks forward to hearing the criteria for choosing a <br />representative for the MPO, and said that he would like to see a break with the status quo <br />regarding traffic planning in the City. Mr. Lynch noted that only 2% of the MPO budget <br />is spent on alternative transportation~ Mr. Lynch said he would like to see the City <br />representatives on the MPO be leaders in keeping traffic out of the City. Mr. Lynch <br />supported Mr. Cox for appointment on the MPO. <br /> <br /> Ms. Richards said that she is touched by Ms. Hurrelbrinck's remarks. Ms. <br />Richards said she was away on vacation when her statement was aired out of context, and <br />expressed her appreciation to WVIR TV and the Daily Progress for replaying and <br />printing her entire statement. Ms. Richards reassured the public that her statement was <br />meant to reflect an appreciation for diversity in the mayorship, and said that she regrets <br />that a statement intended to celebrate diversity was misinterpreted. <br /> <br />CONSENT AGENDA <br /> <br /> On motion by Mr. Toscano, seconded by Ms: Richards, the following consent <br />agenda items were unanimously approved, with Mr. Caravati abstaining from approval of <br />the minutes of June 1 and 15. <br /> <br />a. RESOLUTION: <br /> <br />Approving Sidewalk Caf6 for Durango Bagel <br /> <br /> WHEREAS, Andrew Nevelos has applied to City Council for a permit to operate <br />an outdoor caf6 on the pedestrian mall at 118-A West Main Street in cormection with the <br />operation of his duly licensed restaurant (Durango Baagel); and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor caf6 is in keeping with <br />the intent of the pedestrian mall, can add significantly to successful commerce in the <br />downtown area, will not unreasonably restrict the movement of pedestrian traffic and will <br />not endanger the public health, safety or ~welfare; now, therefore, <br /> <br /> BE IT RESOLVED that Andrew Nevelos is hereby granted a permit to operate <br />an outdoor caf6 on the pedestrian mall at 118-A West Main Street, subject to the <br />following conditions and terms: <br /> <br /> I. The permit shall be valid from its adoption (or effective date if different from <br />the date of adoption) until November 30, 2000, for operation of the caf6 during the <br />months of March through November. Not later than November 30 of each year, the <br />operator shall remove from public property all furniture and equipment used for such caf6 <br />operation. <br /> <br /> 2. The caf6 shall be operated only in the designated area shown on the attached <br />sketch. The caf6 shall be in operation only during the hours the restaurant is open. No <br />caf6 furnishings or equipment shall be permitted to obstruct any fh-e lane. The designated <br />area of operation shall be clearly delineated by the use of a combination of trees, fences, <br />planters and barriers. <br /> <br /> <br />
