30 <br /> <br /> Mr. Gouldman explained that the applicant has asked that the pitch of the roof <br />stay as it is now. <br /> <br /> Mr. Summers recommended that the resolution reflect that the structure is <br />approved as proposed at the August meeting of the BAR, with the roofline as it exists, <br />devoid of eaves. <br /> <br /> Ms. Driscoll noted that the slope of the roof was built to meet code, but the BAR <br />wanted it to be flatter. <br /> <br /> Mr. Caravati said he does not think that changing the roofline will affect what is <br />visible. <br /> <br /> Mr. Toscano amended his motion to not that the BAR vote was not unanimous <br />and adding a clause saying that the certificate of appropriateness is approved provided <br />that it confirms to the description and sketches shown to Council as modified by the <br />applicant's presentation on January 4, 1999. <br /> <br />Ms. Richards said she will abstain from voting on the appeal. <br /> <br /> The resolution approving the certificate of appropriateness was approved by the <br />following vote. Ayes: Mr. Caravati, Ms. Daugherty, Ms. Toscano. Noes: None. <br />Abstaining: Ms. Richards. Absent: Mr. Cox. <br /> <br /> WHEREAS, the owner of a property located at 101 W. South Street (the <br />"Applicant") has sought a certificate of appropriateness from the City of <br />Charlottesville Board of Architectural Review (the "BAR") for a 14.5' by 20' roof <br />top addition to her warehouse property; and <br /> <br /> WHEREAS, the Applicant has appeared in front of the BAR in an effort to <br />obtain said certificate of appropriateness on four (4) separate occasions in May, <br />June, July, and August of 1998; and <br /> <br /> WHEREAS, as a result of said separate appearances, the Applicant has <br />made a number of proposed changes to the addition; and <br /> <br /> WHEREAS, on August 18, 1998, the BAR voted to deny the sought after <br />certificate, and the Applicant has appealed that decision to Council pursuant to <br />City Code § 34-584; and <br /> <br /> WHEREAS, this Council has examined the relevant evidence in the <br />record, including descriptions and sketches of the addition, as currently <br />constructed and proposed for modification, and has reviewed the minutes of the <br />BAR, has heard fi'om the Applicant and the BAR, and has listened to presentations <br />from persons with alleged standing to be heard; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that this Council fmds as <br />follows: <br /> <br /> 1. The proposed addition, which will cover 4.8% of the existing warehouse <br />roof, is compatible with the historic, cultural, and architectural character of the <br />property and the subject historic district; and <br /> <br /> 2. The material, texture, color, height, scale, mass, and placement of the addition <br />are visually compatible with the site and the applicable design control district; and <br /> <br /> 3. The proposed changes in terms of overall proportion and size and placement of <br />entrances, and windows are in harmony with each other and with the existing structure; <br />and <br /> <br /> <br />
