30 Mr. Gouldman explained that the applicant has asked that the pitch of the roof stay as it is now. Mr. Summers recommended that the resolution reflect that the structure is approved as proposed at the August meeting of the BAR, with the roofline as it exists, devoid of eaves. Ms. Driscoll noted that the slope of the roof was built to meet code, but the BAR wanted it to be flatter. Mr. Caravati said he does not think that changing the roofline will affect what is visible. Mr. Toscano amended his motion to not that the BAR vote was not unanimous and adding a clause saying that the certificate of appropriateness is approved provided that it confirms to the description and sketches shown to Council as modified by the applicant's presentation on January 4, 1999. Ms. Richards said she will abstain from voting on the appeal. The resolution approving the certificate of appropriateness was approved by the following vote. Ayes: Mr. Caravati, Ms. Daugherty, Ms. Toscano. Noes: None. Abstaining: Ms. Richards. Absent: Mr. Cox. WHEREAS, the owner of a property located at 101 W. South Street (the "Applicant") has sought a certificate of appropriateness from the City of Charlottesville Board of Architectural Review (the "BAR") for a 14.5' by 20' roof top addition to her warehouse property; and WHEREAS, the Applicant has appeared in front of the BAR in an effort to obtain said certificate of appropriateness on four (4) separate occasions in May, June, July, and August of 1998; and WHEREAS, as a result of said separate appearances, the Applicant has made a number of proposed changes to the addition; and WHEREAS, on August 18, 1998, the BAR voted to deny the sought after certificate, and the Applicant has appealed that decision to Council pursuant to City Code § 34-584; and WHEREAS, this Council has examined the relevant evidence in the record, including descriptions and sketches of the addition, as currently constructed and proposed for modification, and has reviewed the minutes of the BAR, has heard fi'om the Applicant and the BAR, and has listened to presentations from persons with alleged standing to be heard; NOW, THEREFORE, BE IT RESOLVED that this Council fmds as follows: 1. The proposed addition, which will cover 4.8% of the existing warehouse roof, is compatible with the historic, cultural, and architectural character of the property and the subject historic district; and 2. The material, texture, color, height, scale, mass, and placement of the addition are visually compatible with the site and the applicable design control district; and 3. The proposed changes in terms of overall proportion and size and placement of entrances, and windows are in harmony with each other and with the existing structure; and
