33 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the City of Charlottesville <br />requests the Commonwealth Transportation Board to establish a project for the <br />improvement of "West Main Street Pedestrian Link;" <br /> <br /> BE IT FURTHER RESOLVED, that the City of Charlottesville hereby agrees to <br />pay 20 percent of the total cost for planning and design, right of way, and construction of <br />this project, and that if the City of Charlottesville subsequently elects to cancel this <br />project, the City of Charlottesville hereby agrees to reimburse the Virginia Department of <br />Transportation for the total amount of costs expended by the Department through the date <br />the Department is notified of such cancellation. <br /> <br /> WHEREAS, in accordance with Commonwealth Transportation Board <br />construction allocation procedures, it is necessary that a request by resolution be received <br />from the local government or state agency in order that the Virginia Department of <br />Transportation program an enhancement project in the City of Charlottesville; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the City of Charlottesville <br />requests the Commonwealth Transportation Board to establish a project for the <br />improvement of "Court Square Initiative;" <br /> <br /> BE IT FURTHER RESOLVED, that the City of Charlottesville hereby agrees to <br />pay 20 percent of the total cost for planning and design, right of way, and construction of <br />this project, and that if the City of Charlottesville subsequently elects to cancel this <br />project, the City of Charlottesville hereby agrees to reimburse the Virginia Department of <br />Transportation for the total amount of costs expended by the Department through the date <br />the Department is notified of such cancellation. <br /> <br />RESOLUTION: APPROVING CITY'S LEGISLATIVE PACKAGE <br /> <br /> Ms. Daugherty asked Councilors if they agree with the language added to the <br />Legislative Package following their previous discussion. <br /> <br /> Ms. Richards said that in the service of human rights and non-discrimination, she <br />supports amending the state's hate crime laws to include sexual orientation. Ms. Richards <br />said that she thinks it is the duty of government to protect citizens against all forms of <br />discrimination, noting that the 1994 hate crime legislation passed by the General <br />Assembly does not include sexual orientation. Ms. Richards made a motion to adopt the <br />resolution encouraging passage of such legislation. <br /> <br /> Mr. Toscano seconded the motion and asked if there is a reason why gender and <br />disabilities are left out of the resolution. <br /> <br />Ms. Richards said that the state did not include gender and disabilities. <br /> <br /> The resolution was approved by the following vote. Ayes: Mr. Caravati, Ms. <br />Daugherty, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. <br /> <br /> WHEREAS, hate crimes committed against gays, lesbians and bisexuals make up <br />the third largest category of hate crimes reported to the FBI; and <br /> <br /> WHEREAS, Congress held this past July hearings to amend current federal law <br />to include sexual orientation, gender and disability and to expand federal law <br />enforcement jurisdiction through the Hate Crimes Prevention Act, but has not brought the <br />measure up for vote; and <br /> <br /> WHEREAS, University of Wyoming student, Matthew Shepard's murder on <br />October 9, 1998 is yet another instance in a long history of hate crimes directed against <br />gays, lesbians and bisexuals; and <br /> <br /> <br />
