Mr. <br />Toscano said that drawing the district line based on the plat line does not make logical <br />sense and he would like to explore drawing the line in a different way. <br /> <br /> Mr. C°x said that all new buildings on the street have been non-contributing <br />structures, and he questioned how the City can provide guidance for new structures as <br />well as protect the old ones. <br /> <br /> The ordinances entitled "AN ORDFNANCE AMENDING AND REENACTING <br />THE DISTRICT MAP INCORPORATED IN SECTION 34-15 OF THE ZONING <br />ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS <br />AMENDED, BY ADDING A FIFTH MAJOR ARCHITECTURAL DESIGN <br />CONTROL DISTRICT, TO BE IC3XlOWN AS THE WERTLAND STREET <br />ARCHITECTURAL DESIGN CONTROL DISTRICT" and "AN ORDINANCE <br />AMENDING AND REORDAdNING SECTION 34-567 OF THE CODE OF THE CITY <br />OF CHARLOTTESVILLE, 1990, AS AMENDED, RELATED TO PROPERTIES <br />PROTECTED IN THE ARCHITECTURAL DESIGN CONTROL DISTRICTS" were <br />offered and carried over to the next meeting for consideration. <br /> <br />RESOLUTION: APPROVING CAF]2 PERMIT FOR EASTERN STANDARD <br />RESTAURANT <br /> <br /> Mr: Higgins said that Heidi Misslbeck, Planner in the Department of Community <br />Development, began meeting with restaurant owners requesting caf~ permits, and while <br />most issues have been resolved, certain space issues remain. Mr. Higgins said that <br />Eastern Standard has requested a cafb area immediately adjacent to the restaurant in <br />addition to the existing area next to the retaining wall. Mr. Higgins said that staff feel <br />such a configuration creates an awkward pathway through a caf{5 for pedestrians, and <br />recommend that only the existing space be approved. <br /> <br /> Mr. Toscano suggested that the requested space be tried for a year to see how it <br />works. <br /> <br /> Ms. Daugherty expressed concern with the visually impaired who walk through <br />the area. <br /> <br /> Mr. Cox made a motion to allow the caf~ as requested by Eastern Standard, with <br />adequate space for pedestrians to be funneled through the center of the aisle for a one <br />year trial period~ Mr. Toscano seconded the motion and amended it to say that it will be <br />up to staff to work with the owners to design an appropriate walk through. <br /> <br /> Ms. Richards said she thinks there will be more conflicts arising as a result of <br />cafes and said there is probably a need to devise a master plan. Ms. Richards said a <br />sunset clause may be needed for caf6 permits to allow such a plan to be developed. <br /> <br /> Mr. Toscano said he feels that Ms. Richards concern has already been addressed <br />by the map provided by staff showing caf6 locations and by the fact that staff has met <br />with caf~ owners. <br /> <br /> Mr. Gouldman nOted that there is nothing in the ordinance to allow staffto work <br />on caf~ designs after approval by Council. <br /> <br /> Mr. Cox amended his motion to say that a 5 foot corridor should be left open <br />between the new and existing caf~ areas, with sufficient screening in the table area. <br /> <br /> The resolution approving the caf~ permit for Eastem Standard Restaurant, as <br />amended, was approved by the following vote. Ayes: Mr. Caravati, Mr. Cox, Ms. <br />Daugherty, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br /> WItEREAS, Douglas Smith has applied to City Council for a permit to operate <br />an outdoor caf~ on the pedestrian mall at 102 Old Preston Avenue in connection with the <br />operation of its duly licensed restaurant (Eastern Standard); and <br /> <br /> <br />
