<br />A SPECIAL MEETING OF THE COUNCIL WILL BE HELD ON Monday, June 7,
<br />1999 AT 5:30 p.m. IN THE Second Floor Conference Room.

<br /> Council met in special session on this date with the following members present:
<br />-Mr. Caravati, Mr. Cox, Ms. Daugherty, Mr. Toscano. Absent: Ms. Richards.
<br />
<br /> On motion by h/h-. Caravati, seconded by Mr. Toscano, Council voted (Ayes: Mr.
<br />Caravati, Mr. Cox, Ms. Daugherty, Mr. Toscano. Noes: None. Absent: Ms. Richards.)
<br />to meet in executive session for the purpose of appointing members to various City
<br />boards or agencies, and routine annual performance evaluations of specific public officers
<br />and appointees; as authorized by Section 2.1-344(A)(1) of the Virginia Code; for the
<br />purpose of considering the acquisition or use of real property for public purpose, or the
<br />disposition of publicly held property, as authorized by Section 2.1-344(A)(3)of the
<br />Virginia Code, and more specifically described as: property on Elliott Avenue, property
<br />near 9~L10tB Street Connector Road, property on or near Locust Avenue, property in or
<br />near Mclntire Park, property in or near Court Square, property in or near Buck Mountain
<br />in Albemarle County, and property located near the University of Virginia; and for the
<br />purpose of consultation with legal counsel and briefings by staff'members, consultants or
<br />attorneys on three matters pertaining to actual or probable litigation, or other specific
<br />legal matters requiring the provision of legal advice by counsel, as authorized by Section
<br />2.1-344(A)(7) of the Virginia Code.

<br /> Council reconvened in open session and, on motion by Mr, Caravati, seconded by
<br />Mr. Toscano, certified (Ayes: Mr. Caravati, -Mr. Cox, Ms. Daugherty, Mr. Toscano.
<br />Noes: None. Absent: Ms. Richards) that, to the best of each member's knowledge, (i)
<br />only public business matters lawfully exempted from open meeting requirements by
<br />Virginia law were discussed in the executive meeting to which this certification
<br />resolution applies, and (ii) only such public business matters as were identified in the
<br />motion convening the executive meeting were heard, discussed or considered by the
<br />Council.

<br />RESOLUTION: A~MENDING SERVICE AGREEMENT FOR THE BLUE RIDGE
<br />DETENTION CENTER
<br />
<br /> On motion by Ms. Daugherty, seconded by Mr. Toscano, the resolution amending
<br />the service agreement for the Blue Ridge Detention Center (removing the requirement
<br />that localities approve the location of the ske for the detention facility) was approved by
<br />the following vote. Ayes: Mr. Caravati, Ms. Daugherty, Mr. Toscano. Noes: Mr. Cox.
<br />Absent: Ms, Richards.
<br />
<br /> WHEREAS, orrMay 17, 1999, the Charlottesville City Council, prior to
<br />approvaI~ amended the Service Agreement for the BlueRidge Juvenile Detention Center
<br />by inserting language in Section 2. I of said agreement which would require each Member
<br />Jurisdiction of the Blue Ridge Juvenile Detention Commission to approve the location of
<br />the site for the detention facility; and
<br />
<br /> WHEREAS, this Council, after consultation with representatives of the other
<br />governing bodies of the Member Jurisdictions, has agreed to rescind the amendment;
<br />now, therefore,
