276 <br /> <br /> Mr. Toscano asked if both City representative were at the meeting and if the vote <br />was unanimous. Mr. Toscano also asked ifVDOT is precluded from taking land if funds <br />come from elsewhere. <br /> <br /> Ms. Richards said she was the only City representative, and that VDOT is not <br />precluded from taking land if funds come from elsewhere. Ms. Richards said that the <br />County wants to have a consultant help with identifying land for parkland. Ms. Richards <br />said she would like Angela Tucker to give Council's a report on VDOT's latest plan. <br /> <br /> Ms. Daugherty asked that a copy of the MPO design committee's sugge~ion <br />regarding a consultant be sent to Council. <br /> <br /> Mr. Caravati noted that funding of the jail will increase by at least $1 million next <br />year. <br /> <br /> Ms, Richards said that the Governor's bmtget includes a feasibil~y study that <br />would require a local contribution to cover indigent health care, and suggested that <br />Council write to the University of Virginia and request that the City be represented in that <br />study process. <br /> <br /> Councilors agreed with Ms, Richards' SUggestion and it was agreed that Ivls. <br />Richards and Ms. Daugherty will draf~ a letter. <br /> <br /> On motion by Ms. Richards, seconded by Mr. Toscano, Council voted (Ayes: Mr. <br />Caravati, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox) <br />to meet in a closed session for the purpose of considering the acquisition of real property <br />for public purpose, or the disposition of publicly held property, when discussion in an <br />open meeting would adversely affect the bargaining position or negotiating strategy of <br />the City, as authorized by Section 2.1-344(A)(3) of the Virginia Code, and more <br />specifically described as (I) property on 1st Street; (2) property offDoUglas Avenue; and <br />(3) property on Emmet Street; and for the purpose of consultation with legal counsel and <br />briefings by staff members, consultants or attorneys on a matter pertaining to actual or <br />probable litigation, where such briefing in an pen meeting would adversely affect the <br />negotiating or litigating position of the City, or consultation with legal counsel employed <br />or retained by a public body regarding specific legal matters requiring the provision of <br />legal advice by such counsel, as authorized by Section 2.1-344(A)(7) of the Virginia <br />Code. <br /> <br /> Council reconvened in open session and, on motion by Mr. Toscano, seconded by <br />Mr. Caravati, approved the following certification of closed meeting by the following <br />vote. Ayes: Mr. Caravati, Ms. Daugherty, Ms. Richards, Mr. Toseano. Noes: None. <br />Absent: Mr. Cox. <br /> <br /> WltEREAS, the City Co--il has convened a closed meeting on tiffs date pursuant <br />to an alTn:mative recorded vote and in accordance with the provisions of the Virginia <br />Freedom of Information Act; and <br /> <br /> ~REAS, Section 21.344. t of the Code of Virginia requires a certification by the <br />Council that such closed meeting was conducted in conformity with Virginia law; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council hereby certifies <br />that, to the best of each member's knowledge, (i) only public business matters lawfully <br />ex_erupted from open meeting requirements by Virginia law were discussed in the closed <br />meeting to which this certification resolution applies, and (ii) only such public business <br />matters as were identified in the motion convening the closed meeting were heard, <br />discussed or considered by the Council. <br /> <br /> The meeting was adjourned. <br />Pres~5~t ?)~vc~ <br /> <br /> <br />
