by written notice delivered to its place of business at least ten days before such meeting, <br />if the Council fmds: (a) that the operator is violating the terms of the permit; (b) is <br />delinquent in paying rent; (c) that the continued operation of the caf~ poses a threat to the <br />public health, safety or welfare or constitutes a public nuisance; or (d) if by June tst in <br />any calendar year covered by this permit, the outdoor caf6 has not been in substantial <br />operation for a period of 60 days, or if the caf~ ceases operation for a period of 30 days or <br />more prior to Labor Day of any year. <br /> <br /> 9. This permit may be revoked at any time upon six moths' notice to the <br />operator, for any public purpose as determined by the City Council. <br /> <br /> 10. Approval of this permit is conditioned upon the applicant's continued <br />compliance with the plans approved by the Board of Architectural ReView. <br /> <br /> 11. This permit shall not be assigned without the express permission of City <br />Council. <br /> <br />f. RESOLUTIONS: <br /> <br />Va. Dept. of Transportation- installation of <br />Traffic Signals (2) <br /> <br /> WHEREAS, in accordance with Virginia Department of Transportation <br />construction allocation procedures, it is necessary that a request by Council <br />resolution be made in order that the Department program an urban highway <br />project in the City of Charlottesville; now, therefore <br /> <br /> BE IT RESOLVED, that the Council of the City of Charlottesville, <br />Virginia requests the Virginia Department of Transportation to establish an urban <br />system highway project for design and installation of traffic signals at six locations <br />in the City of Charlottesville; and <br /> <br /> BE IT FIIRTHER RESOLVED that tlhe Council of the City of <br />Charlottesville hereby agrees to pay its share of the total cost for preliminary <br />engineering, right of way and construction of this' project in accordance with <br />Section 33.1-44 of the Code of Virginia, and that, if the City of Charlottesville <br />subsequently elects to cancel this project, the City of Charlottesville hereby agrees <br />to reimburse the Virginia Department of Transportation for the total amount of the <br />costs expended by the Department through the date the Department is notified of <br />such cancellation. <br /> <br /> WHEREAS, in accordance with Virginia Department of Transportation <br />construction allocation procedures, it is necessary that a request by Council <br />resolt.~on be made in order that the Department program an urban highway <br />project in the City of Charlottesville; now, therefore <br /> <br /> BE IT RESOLVED, that the Council of the City of Charlottesville, <br />Virginia requests the Virginia Department of Transportation to establish an urban <br />system highway project for the coordination and interconnection of traffic signals <br />along Emmet Street and the U.S. 250 Bypass from Hydraulic Road to Barracks <br />Road; and <br /> <br /> BE IT FURTHER RESOLVED that the Council of the City of <br />Charlottesville hereby agrees to pay its share of the total cost for preliminary <br />engineering, right of way and construction of this project in accordance with <br />Section 33.1-44 of the Code of Virginia, and that, if the City of Charlottesville <br />subsequently elects to cancel this project, the City of Charlottesville hereby agrees <br />to reimburse the Virginia Department of Transportation for the total amount of the <br /> <br /> <br />
