<br />position or negotiating strategy of the City, as authorized by Section 2.1-344(A)(3) of the
<br />Virginia Code; and 3) for the purpose of consultation with legal counsel and briefmgs by
<br />staff members, consultants or attorneys on one matter pertaining to actual or probable
<br />litigation, where such briefing in an open meeting would adversely affect the negotiating
<br />or litigating positions of the City, and consultation with legal counsel employed or
<br />retained by a public body regarding another specific legal matter requiring the provisions
<br />of legal advice by such counsel, each as authorized by Section 2.1-344(A)(7) of the
<br />Virginia Code (2 separate matters).

<br /> Council reconvened in open session and, on motion by Mr. Caravati, seconded by
<br />Mr. Toscano, approved the following certification ofclosed meeting by the following
<br />vote. Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes:
<br />None.

<br /> WltEREAS, the City Coumcil has convened a closed meeting on this date pursuant
<br />to an affirmative recorded vote and in accordance with the provisions of the Virginia
<br />Freedom of Information Act; and
<br />
<br /> WItEREAS, Section 21.344. t of the Code of Virginia requires a certification by the
<br />Council that such closed meeting was conducted in conformity with Virginia Iaw;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED that the City Council hereby certifies
<br />that, to the best of each member's knowledge, (i) only public business matters lawfully
<br />exempted from open meeting requirements by Virginia law were discussed in the closed
<br />meeting to which this certification resolution applies, and (h) only such public business
<br />matters as were identified in the motion convening the closed meeting were heard,
<br />discussed or considered by the Council.

<br />APPOINTMENTS: BOARDS AND COMMISSIONS

<br /> On motion by Mr. Toscano, seconded by Mr. Caravati, Ms. Ruth Stone was
<br />appointed to a two-year term as the private service provider on the Charlottesville/
<br />AIbem~'le Commission on Ch~dren and Families by the following vote. Ayes: Mr.
<br />Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes: None. As this is
<br />a joint appointment with Albemarle County, this appointment is conditioned on
<br />appointment of Ms. Stone by the Board of Supervisors.

<br /> On motion by Mr. Toscano, seconded by Mr. Caravati, Mr. Hovey Dabney and Ms,
<br />Susan Garrett were reappointed to two-year terms on the Jefferson Area Board for Aging
<br />by the following vote. Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr.
<br />Toscano. Noes: None.

<br /> On motion by Mr. Toscano, seconded by Mr. Caravati, Ms. Virginia Roy 'was
<br />reappointed to a two-year term on the Jefferson Area Board for Aging Advisory Council
<br />on Aging by the following vote. Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms.
