147 McIntire, property on 6t~ Street, N.E., and property in downtown Charlottesville; and for the purpose of consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating position of the City, or consultation with legal counsel employed or r~ained by a public body regarding specific legal matters requiring the provision oflegal advice by such counsel, as authorized by Section 2.1-344(A)(7) of the Virginia Code. Council reconvened in open session and, on motion by Mr. Toscano, seconded by Ms. Richards, approved the following certification of closed meeting by the following vote. Ayes: Mr. Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. WHEREAS, the City Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and WHEREAS, Section 21.344.1 of the Code of Virginia requires a certification by the Council that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Council. AppOINTMENTS: BOARDS AND COMMISSIONS On motion by Ms. Richards, seconded by Mr. Toscano, Council reappointed Ms. Melissa Dickens to a four-year term on the Jefferson-Madison Regional Library Board by the following vote. Ayes: Mr. Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. This term will expire on August 31, 2004. On motion by Ms. Richards, seconded by Mr. Toscano, Council reappointed Mr. Claude V. Worrell, II to a two-year term on the Monticello Area Community Action Agency Board by the following vote. Ayes: Mr. Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. This term will expire on July 1, 2002, On motion by Ms. Richards, seconded by Mr. Toscano, Council reappointed Ms. Kathy Icenhour and appointed Mr. James Hingeley to four-year terms on the Social Services Advisory Board by the following vote. Ayes: Mr. Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. These terms will expire on June 30, 2004. //~esidel~f~-
