261 <br /> <br />loss of the softball field, three holes of the golf course, and Rivanna Trails. Mr. Lynch <br />said that the Virginia Department of Conservation has criteria forgiving away land based <br />on fimctional use, and he feels replacement with 50 acres would be an appropriate <br />amount, which would be similar to the ratio which was used when consideration was <br />given to replacing three acres of Pen Park with 15 acres at Riverview Park. Regarding <br />regional transportation and the eastern connector, Mr. Lynch said Council agreed they do <br />not want Meadowcreek Parkway to be the de facto eastern connector, but he does not feel <br />there is a lot of language to keep that from happening. Mr. Lynch said he would support <br />making support of the road contingent on a commitment from Albemarle County and the <br />University of Virginia to update the Three Party Agreement within 90 days, including <br />siting of an eastern connector, an agreement to meet monthly with a goal of completing <br />the Agreement within one year. Mr. Lynch said we have to have a regional plan and <br />come up with a rOad network. Mr. Lynch said it was also pointed out by the biking <br />community that in the appendix to the letter regarding the minimum width of the bike <br />path, the minimum width should be 10 feet, not 8 feet. Mr. Lynch proposed that Council <br />vote on the December 5t~ draft letter from Mr. Caravati. <br /> <br /> Mr. Toscano said that the language proposed by Mr. Lynch interjects too much <br />uncertainty and potential for argument in the future, and said that all the language <br />together is very difficult for him to support and different than what the majority agreed to <br />at the two work sessions. Mr. Toscano said the Metropolitan Planning Organization is <br />charged with transportation planning for the region and for developing a regional <br />transportation plan~ Mr. Toscano said that regarding park replacement, he would like to <br />have "functional" defmed, and noted that even with the proposed 1-5 ratio swap proposed <br />for Pen Park and Riverview Park, the proposal was rejected. Mr. Toscano said Mr. <br />Lynch's language is a recipe for further dissention and problems down the road, and he <br />cannot support his suggestions. <br /> <br /> Mr. Caravati said he will vote against the November 17th letter and prefers the <br />November 30th letter, saying that the content of it has not changed from the November <br />17th letter. <br /> <br /> The draft November 17th letter was rejected by the following vote. Ayes: Ms. <br />Richards and Mr. Toscano. Noes: Mr. Caravati, Mr. Cox, Mr. Lynch. <br /> <br /> Mr. Caravati made a motion to approve the November 306 letter which he said <br />contains numerous wordsmithing changes, with an additional amendment, having access <br />for bike and pedestrian travel at Mclntire Road be accommodated at grade and the bike <br />path 10 feet in width. <br /> <br /> Mr. Cox seconded the motion, but then withdrew his motion upon further <br />clarification of the motion. <br /> <br />Ms. Richards seconded the motion. <br /> <br /> Mr. Cox said the issue of greatest concern to Council and people who have <br />scrutinized the road is that the City will get left with a de facto eastern connector. Mr. <br />Cox said that without a commitment to revisit the Three Party Agreement we have no <br />commitment to regional planning. Mr. Cox said this cannot be done in the context of the <br />MPO and he feels it is an essential component to any agreement. Mr. Cox said there has <br />to be a process to update the Agreement, and the proposed letter is unacceptable, though <br />he could support a letter that puts that requirement in place. <br /> <br /> Mr. Toscano offered a friendly amendment adding that the pond is essential, and <br />Mr. Camvati and Ms. Richards accepted the amendment. <br /> <br /> Mr. Toscano offered a friendly amendment to insert "and greenspace" after <br />"parkland," and Mr. Caravati and Ms. Richards accepted the amendment. <br /> <br /> Mr. Toscano offered a friendly amendment to refer to a "larger park network," but <br />Mr. Caravati suggested "a greater contiguous park," and Mr. Toscano agreed and Ms. <br />Richards accepted the amendment. <br /> <br /> <br />
