19 <br /> <br /> WHEREAS, the Virginia Litter Control Act of 1976 provides, <br />through the Department of Conservation and Economic Development, <br />Division of Litter Control, for the allocation of public funds <br />in the form of grants for the purpose of enhancing local litter <br />control programs; NOW, THEREFORE, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that the City: <br /> <br /> 1. Endorses and supports the continuation of such a program <br />for the City of Charlottesville; <br /> <br /> 2. Expresses its intent to combine with the County of <br />Albemarle in a mutually agreed upon and cooperative program, <br />contingent on approval of the application by the Department of <br />Conservation and Economic Development, Division of Litter Control, <br />and contingent on receipt of funds; <br /> <br /> 3. Authorizes the Charlottesville-Albemarle Clean Community <br />Commission (CAC3) to plan and budget for a cooperative litter <br />control program; <br /> <br /> 4. Authorizes CAC3 to apply on behalf of both the City and <br />County for a grant, and to be responsible for the administration, <br />implementation, and completion of the program; <br /> <br /> 5. Accepts responsibility jointly with CAC3 and the County <br />of Albemarle for all phases of the program; <br /> <br /> 6. Accepts liability for its pro rata share of any funds <br />not properly used or accounted for pursuant to the regulations <br />of the application, and agrees that the state funds, when <br />received, will be transferred immediately to CAC3, to be used <br />in the cooperative program; and <br /> <br /> 7. Requests the Department of Conservation and Economic <br />Development, Division of Litter Control, to consider and approve <br />the application and program, in accord with regulations governing <br />use and expenditure of said funds. <br /> <br />RESOLUTION: APPROVING CITY MANAGER'S EMPLOYMENT CONTRACT <br /> <br /> Mr. Roger Wiley, City Attorney, summarized the employment <br />contract for the City Manager. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, the City <br />Manager's employment contract was unanimously approved by Council. <br /> <br /> BB IT RESOLVED by the Council of the City of Charlottesville, <br />that the Mayor is hereby authorized to execute on behalf of the <br />City the following document, in form approved by the City Attorney: <br /> <br />Employment Agreement with City Manager Cole Hendrix <br /> <br /> A copy of such document shall be kept on file with the <br />minutes of the Council meeting at which this resolution was <br />adopted. <br /> <br />RESOLUTION: APPOINTING VIEWERS TO CONSIDER CLOSING A PORTION OF <br />AN ALLEY OFF 1ST STREET BETWEEN SOUTH AND WATER STREET <br /> <br /> Mr. Hendrix noted that one side of the alley in question <br />is owned by the City. <br /> <br /> On motion by Mr. Barnes, seconded by Dr. Gunter, the <br />resolution appointing viewers to consider closing a portion <br />of an alley between South and Water Streets was unanmmously <br />approved by Council. <br /> <br /> WHEREAS, this Council has received a petition requesting <br />vacation of a portion of an alley off First Street, approximately <br />66 feet long, and parallel to Parcels # 69 and #70 to the south <br />and Parcel #71 to the north on City Real Property Tax Map 28; and <br /> <br /> <br />
