Mr. Buck added that he felt that the hardship <br />was marginal, but, coupled with the strong plan from a <br />design standpoint, he supported the special permit. <br /> <br /> Responding to a question by Mr. Barnes, Mr. Huja <br />stated that there were no other buildings which had been <br />approved or built prior to the ordinance change which <br />would be requesting similar special permits. <br /> <br /> The resolution approving the special permit for <br />increased density at 112 Montebello Circle was unanimously <br />approved by Council. <br /> <br /> WHEREAS, application has been made for a special use <br />permit to allow for ~occupancy by up to 6 unrelated persons <br />per unit in four 3-bedroom apartment units at 112 Montebello <br />Circle under Section 31-28 (k) of the Code of the City of <br />Charlottesville, as amended; and <br /> <br /> WHEREAS, the site plan for the proposed apartments <br />was approved, bUt improvements had not yet been made, prior <br />to the adoption of Section 31-28 (k); and <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and <br />held on April 9, 198S, this Council finds that such units <br />will conform to the standards set forth in Section 31-28(k) <br />and to the criteria applicable to special permits generally <br />under Chapter 31 of the City Code; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottes- <br />ville that a special use permit is granted pursuant to City <br />Code Section 31-28, as amended, to allow occupancy by up <br />to 6 unrelated persons per unit in the four 3-bedroom <br />apartment units on the property at 112 Montebello Circle, <br />designated as Parcel 34 on City Real Property Tax Map 16. <br />At least 21 off-street parking spaces will be provided in <br />accordance with the amended site plan dated July 20, 1984. <br /> <br />RESOLUTION: SPECIAL PERMIT FOR OUTDOOR CAFE FOR TH~ NOOK, LTD. <br /> <br /> Mr. Jack Rinehart, an architect representing the Nook, <br />Ltd., stated that the design for the proposed outdoor cafe <br />had been designed to be similar to other elements on the <br />downtown mall and had been approved, with the exception of <br />the color scheme, by the Downtown Board of Architectural <br />Review. <br /> <br /> Following a discussion of the amount of space necessary <br />for pedestrian traffic, it was suggested that tables <br />immediately adjacent to the Nook Restaurant be allowed only <br />after S:00 p.m. <br /> <br /> Mr. Richard Rebori, owner of the Nook Restaurant, was <br />given an opportunity to study the proposed special permit <br />and action on the resolution was deferred~until later in the <br />meeting. <br /> <br />RESOLUTION: LITTER CONTROL PROGRAM <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, <br />the resolution authorizing the Charlottesville-Albemarle <br />Clean Community 'Commission (CAC3) to plan a program for <br />litter control and to apply for available grants was <br />unanimously approved by Council. <br /> <br /> WHEREAS, this Council has recognized the existence of <br />a litter problem within the. boundaries of the City of <br />Charlottesville; and <br /> <br /> <br />
