37 <br /> <br />the noise level of 65 db. was too high, and in addition, Mr. <br />Buck questioned the requirement of an attendant being required <br />at all vendor carts. <br /> <br />ORDINANCE: CLOSING A PORTION OF AN ALLEY OFF 1ST STREET BETWEEN <br />SOUTH AND WATER STREETS <br /> <br /> Mr. Hendrix stated that neither the staff nor the viewers <br />had objections to closing the alley off 1st S~r.ee~ between South <br />and Water Streets. <br /> <br /> On motion by Mrs. Gleason, seconded by Mr. Barnes, the <br />ordinance entitled "AN ORDINANCE CLOSING, VACATING AND DIS- <br />CONTINUING A PORTION OF AN ALLEY OFF FIRST STREET BETWEEN SOUTH <br />AND WATER STREETS" was offered and carried over to the next <br />meeting for consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Wiley stated that the residents of Glenn Court were <br />again requesting that the land owned by the City between Glenn <br />Court and Chapel Hill Road be sold to the adjacent property <br />owners. Mr. Wiley stated that the Chapel Hill property owners <br />have possible rights to a portion of the property, but the <br />Glenn Court residents had agreed to make the conveyance subject <br />to whatever rights the Chapel Hill residents were found to have. <br /> <br /> Mr. Buck asked if a restrictive covenant could be attached <br />to the sale which would prohibit access to Glenn Coqr~t..from <br />Chapel Hill Road. <br /> <br /> Mr. Wiley replied that he was concerned 'th~atlthe ~re~strictive <br />covenant might remoe a legal right the City residents might have. <br /> <br /> The item was carried over to the next meeting when it could <br />be advertised on the agenda. <br /> <br /> Mr. Hendrix advised Council that Burnley-Moran and Johnson <br />Elementary Schools may qualify as summer nutrition sites and if <br />that occurred, the cost to the City for increased staffing would <br />be approximately $4,200. <br /> <br /> Mrs. Gleason asked why the backlog existed for drainage <br />and sidewalk projects. <br /> <br /> Mr. Henndrix replied that the backlog resulted both because <br />of holdups receiving easements from property owners and a backlog <br />at the engineering level. <br /> <br /> On motion by Mr. Barnes, seconded by Mrs. Gleason, Council <br /> voted to meet in executive session to discuss acquisition of property <br /> and ~egal matters as exempted by Section 2.1-344(a)(2) and (6) <br /> of~nia Freedom of Information Act. <br />~g was adjourned, k~~ ~~ <br /> <br /> <br />
