The Bonds shall no- be issued unless the)- shall <br />have received an allocation of the State Ceiling (as <br />defined in the Order), and nothing in this resolution <br />shall be construed as any assurance that such allocation <br />will be available, or if available, will be made. <br /> <br /> 6. Pursuant to the limitations contained in Temporary <br />Income Tax Regulations Section 5f.103-2(f)(1), this <br />resolut'ion shall remain in effect for a period of one year <br />from the date of its adoption. <br /> <br /> 7. This Resolution shall take effect immediately <br />upon its adoption. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT FOR INCREASED DENSITY <br />FOR l~5-167 CHANCELLOR STREET <br /> <br /> Mr. Buck stated that he would abstain from discussing <br />the resolution due to a possible conflict of interest. <br /> <br /> Mr. Satyendra Huja, Director of Community Development, <br />reviewed the request for a special permit to house up to <br />33 persons at 165 and 167 Chancellor Street. Mr. Huja <br />listed the reasons given by the Planning Commission for <br />recommending approval of the special permit as follows~ <br />1) It is in harmony with the Land Use Plan of the Compre- <br />hensive Plan, 2) It will not have a significant-adverse <br />impact.on the surrounding area if condition.s are met, <br />3) The proposed setback modification are in keeping with <br />the purpose and intent of the Zoning Ordinance, as amended, <br />4) It will permit the renovation of two existing non- <br />conforming structures for use by a single group, ~) The <br />proposed use is compat.ible with surrounding uses. This <br />approval is conditional upon the following Conditions: <br />1) Administrative approval of the site plan with the <br />following conditions: a) Complete information on property <br />boundaries; b) More complete information on method of <br />handling drainage, and; c) More complete information on <br />utility connections, 2) The elevated sidewalk to the south <br />on Chancellor Street mu~t be repaired and vegetation <br />cleared to remove obstructions, 3) That the curb radius <br />at the corner of Madison Lane and Chanellor Street be increased <br />as much as possible without removing significant vegetation <br />on-site (e.g. approximately a ten foot radius). <br /> <br /> Mrs. Gleason stated that there had been a request by <br />Mr. Jeff Taylor to defer a decision on the resolution. <br /> <br /> Mr. Jeff Taylor, a resident of 167 Chancellor Street, <br />sta'ted that he was concerned about parking and presented a <br />petition signed by Corner merchants and area residents <br />opposing the special permit. <br /> <br /> Mr. William Daggett, Architect for Alpha Phi Sorority, <br />who requested the special permit, asked that a decision be <br />made at the present meeting due to the time constraints <br />involved in completing the project by the end of the year <br />in order to qualify for tax breaks. <br /> <br /> Dr. Hall stated that he was not in favor of delaying <br />a decision as proper procedures had been followed for the <br />special permit. <br /> <br /> The resolution granting a special permit for increased <br />density at 165 and 167 Chancellor Street was moved by Dr. <br />Hall and seconded by Mr. Barnes. <br /> <br /> Mr. Barnes stated that he did not think the difference <br />in 33 and 24 persons, which would be allowed by right, would <br />have a significant impact on the neighborhood and noted that <br />one of the structures is presently in a blighted condition. <br /> <br /> <br />
