69 <br /> <br /> Mrs. Gleason stated her intent to support the resolution <br />and stressed that it was important to enforce the parking <br />regulations in the area. <br /> <br /> Dr. Gunter stated that she was in favor of the resolution <br />and recommended that the sorority make an effort to work <br />with the neighborhood especially ~n the congested area. <br /> <br /> The resolution granting a special permit to Alpha Phi <br />Sorority for increased density at 165 and 167 Chancellor <br />Street was approved by the following vote. Ayes: Mr. Barnes, <br />Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. Abstaining: <br />Mr. Buck. <br /> <br /> WHEREAS~ House Corporation for Alpha Phi Sorority has <br />submitted an application for a special permit to use the <br />structures and properties at 165 and 167 CHancellor Street <br />together for a sorority complex, and for a modification of <br />the normally required Setback of 36 feet on Madison Lane; and <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on July 9, 1985, this Council finds that such use will conform <br />to the standards set forth in Section 31-28.1 of the City Code <br />and to the criteria applicable to special permits generally <br />under Chapter 31 of the City Code, and that the r,equested <br />modification of the setback requirement should be granted <br />pursuant to City Code Section 31-228.1; now, therefore, <br /> <br /> BE tT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that a special use permit is granted pursuant to City <br />Code Section 31-2,8, as amended, to allow the use of str~ctures <br />and properties at 165 and 167 Chancellor Street, identified on <br />City Real Property Tax Map 9 as Parcels 126 and 127, as a <br />sorority complex with a maximum of thirty-three residents. <br />Such use shall be carried out in acc'ordance with the site plan <br />as approved by the Director of Planning. As a condition of <br />such special permit, the normal average setback requirement of <br />36 feet on the Madison Lane frontage of such parcels shall be <br />modified as shown on the approved site plan. <br /> <br />RESOLUTION: <br /> <br />DELIGHT <br /> <br />GRANTING PERMIT FOR OUTDOOR CAFE FOR SAL'S ITALIAN <br /> <br /> Mr. Hendrix presented the formal resolution which had <br />been drawn up following approval of the cafe by Council at <br />its previous meeting. <br /> <br /> On a question from Mr.~ Barnes, Mr. Roger Wiley, City <br />Attorney, replied that the liability insurance limits were <br />the same as other cafes. <br /> <br /> Mr. Huja noted that a vendor 1. ocation was in the.area <br />proposed for the cafe. <br /> <br /> Mr. Wiley stated that the vendor location could be moved <br />just to the east of the cafe. <br /> <br /> The resolution granting a permit for an outdoor cafe for <br />Sal's Italian Delight was moved by Mrs. Gleason, seconded by <br />Dr. Hall and unanimously approved by Council. <br /> <br /> WHEREAS, Giuseppe Finazzo, T/A Sal's Italian Delight, has <br />applied to City Council for a permit to operate an outdoor <br />cafe on the pedestrian mall in the 200 block of East Main <br />Street, in connection with. the operation of its duly licensed <br />restaurant at 221 East Main Street; and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor <br />cafe is in keeping with the intent of the pedestrian mall, <br />can add signfiicantly to successful commerce in the downtown <br />area, will not unreasonably restrict the movement of pedestrian <br />traffic and will not endanger the public health, safety or <br />welfare; now, therefore, be it <br /> <br /> <br />
