122 <br /> <br />Tax Map 30 in order to proceed with a City sidewalk <br />project; and <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City <br />of Charlottesville, Virginia that the City Attomney be <br />and hereby is directed to institute condemnation <br />proceedings for the acquisition of the perpetual <br />easement and right-of-way across a portion of the lot <br />designated as Parcel ?9 on City Real Property Tax Map <br />30 and to file the necessary documents with the Circuit <br />Court for the City of CHarlottesville as provided in <br />Sections 1S.1-898 and 1S.1-899 of the Code of Virginia <br />(19S0), as amended, and Sections 41 and S0.1 of the <br />Charter of the City of Charlottesville, Virginia. <br /> <br />ORDINANCE: REZONING PROPERTY ON EAST SIDE OF STH STREET, S.W. <br />SOUTH~O~WILLOUGHBY SUBDIVISION FROM R-3 TO B-3 (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND <br />REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 <br />OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1976, AS AMENDED, BY THE REZONING OF <br />PROPERTY LOCATED AT FIFTH STREET, S.W." which was offered <br />at the meeting of September 3rd was approved by the <br />following vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, <br />Dr. Gunter, Dr. Hall. Noes: None. <br /> <br />ORDINANCE: RELATING TO AMUSEMENT ARCADES IN M-1 ZONES <br /> <br /> Mr. Hendrix stated that the section pertaining to <br />amusement arcades was inadvertently omitted when the <br />ordinance was amended in 1983. Mr. Hendrix added that <br />the inclusion of the amusement arcades in M-1 zones was <br />recommended by the Planning Commission. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, <br />the ordinance entitled "AN ORDINANCE AMENDING AND RE- <br />ORDAINING SECTION 31-106 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, VIRGINIA, 1976, AS AMENDED, RELATING <br />TO ZONING OF AMUSEMENT ARCADES" was offered and carried <br />over to the next meeting for consideration. <br /> <br />PUBLIC <br /> <br /> There were no matters by the public. <br />OTHER BUSINESS <br /> <br /> Mr. Robert Sheets, Director of Finance, stated that <br />in 1984 the insurance industry had incurred great losses <br />which has made the umbrella policy held by the City very <br />difficult to obtain. Mr. Sheets requested Council's <br />approval of a 90-day extension of the liability policy <br />and noted that the 90-day extension would cost the same as <br />a full year did previously. Mr. Sheets stated that his <br />staff would explore all available sources, in the next few <br />weeks, but that all cities are in a similar situation. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, <br />Council unanimously authorized the 90-day extension for <br />the insurance policy. <br /> <br /> Mr. Hendrix stated that staff hoped to work out a <br />solution to the Short Street closing by the next meeting <br />which would meet the objectives of the different parties <br />involved. <br /> <br /> Mr. Hendrix stated that the ordinance closing the <br />alley between Brandon Avenue and Monroe Lane would be <br />considered at the next meeting. <br /> <br /> <br />
