151 <br /> <br />approval of complete site plans, 2) A grading and soil erosion/ <br />sediment control plan will have to be submitted for review and <br />approval prior to final site plan approval. This should include <br />data on the linear feet of curbing and sidewalk proposed, 3) A <br />homeowner's document will have to be reviewed and approved by <br />the City Attorney prior to final approvals, as outlined in <br />Section 31-73 of the City Code (Zoning Ordinance) as amended, <br />4) A subdivision plat of the PUD Will be needed for review and <br />approval prior to final approval of the site plan, 5) The <br />maintenance agreementsin the. Condominium' ' Association's <br />documents shall clearly state the responsibility of all parties, <br />including the YMCA, in maintenance of common areas, grass areas, <br />use of parking lots (to avoid parking of buses and unauthorized <br />vehicles) and other amenities. This should also clearly <br />prohibit the subleasing of the facilities by condo owners <br />without City approval for other uses, 6) The parking areas <br />should be renovated, resurfaced and additional screening <br />provided, 7) The east side of Birdwood Road should .be defined <br />with a curb, also, 8) The new 30-unit development should be <br />connected to the MClntire Plaza Shopping Center via a pedestrian <br />connection and/or easement, and 9) The steps on Mclntire Road <br />should be linked to the Mclntire Plaza development to the south <br />via a sidewalk. <br /> <br /> Responding to a question regarding placing a traffic <br />signal on the intersection of 250 Bypass and Birdwood Road, <br />Mr. Jim Marshall, Traffic Engineer, stated that the volume of <br />traffic, including that which would be a result of the rezoning, <br />did not justify a signal. Mr. Marshall added that he did not <br />feel a traffic signal would be safe at that location due to <br />poor visibility. <br /> <br /> Mrs. Gleason questioned whether the signal could be <br />placed on the west side of the bridge just west of the <br />intersection. <br /> <br /> Mr. Barnes stated that he felt it was un'desirable to <br />close the median at Birdwood and 250 Bypass and recommended <br />closing~only the median at Hillcrest and 250 Bypass and <br />closely monitoring the situation. <br /> <br /> Mrs. Gleason requested that using Mclntire Plaza as an <br />entrance to the neighborhood be explored. <br /> <br /> Mr. Bill Daggett, developer of the proposed Project, <br />stated that in addition to the problem of gaining access <br />across public property, there was concern that the neighbor- <br />hood would be used as a cut-through by traffic attempting to <br />avoid the Mclntire Road - 250 Bypass intersection. <br /> <br /> Dr. Gunter questioned whether the Birdwood 25.0 Bypass <br />intersection could be signaled to advise caution. <br /> <br /> Mr. Marshall agreed that flashing caution lights could <br />be installed. <br /> <br /> Mr. Wiley noted that off-site improvements could not <br />be required of the developers and also commented that the <br />City could not prohibit sub-leasing of the buildings. <br /> <br /> Mr. Cosner, a resident of the neighborhood, stated that <br />the neighborhood was interested in keeping the median at <br />Birdwood and 250 Bypass open. <br /> <br /> Mrs. Gteason moved the ordinance eh. titled "AN ORDINANCE <br />TO AMEND THE ZONING DISTRICT MAP INCORPORATED BY REFERENCE IN <br />SECTION 31-4 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, BY CHANGING TO THE PLANNED UNIT DEVELOPMENT [PUD) <br />ZONING CLASSIFICATION PROPERTY KNOWN AS THE MCINTIRE SCHOOL <br />SITE," Mr. Barnes seconded the motion and it was carried over <br />to the next meeting for consideration. <br /> <br /> <br />
