184 <br /> <br />ORDINANCE: AMENDING ZONING ORDINANCE <br /> <br /> Mr. Satyendra Huja, Director of Community Development, <br />stated that most changes were administrative in nature <br />and outlined other changes including the following: <br />1) changing historic applicability from 1880 to 188S, <br />2) control of signs of a permanent nature inside business <br />but visible from ~the outside in the historic districts, <br />3) listing home occupations which are not allowed, and <br />4) expanding regulation of maintenance and repair of <br />structures to the downtown historic district. <br /> <br /> Mr. Buck stated that he felt there would be problems <br />enforcing the amendment concerning indoor signs and <br />recommended considering regulating only those visible from <br />ten feet away from the building. <br /> <br /> Mr. Wiley stated that he did not feel that State <br />enabling legislation gave the City the jurisdiction over <br />maintenance of structures. Mr. Wiley added that he felt <br />the existing authority for the Board of Architectural <br />Review to legislate maintenance was questionable. <br /> <br /> Council requested a more detailed description of <br />those buildings which would be included if the historic <br />designation was changed to 1885. <br /> <br /> On motion by Dr. Hall, seconded by Mr. Buck, the <br />ordinance entitled "'AN ORDINANCE TO AMEND AND REORDAIN <br />SECTIONS 31z3, 31-S, 31-13, 31-27, 31-33, 31-34, 31-66,-~ <br />31-70, 31-79, 31-85, 31-92, 31-120, 31-127.2, 31-141, <br />31-159, 31-183, 31-195, 31-196, 31-200, 31-201, 31-202, <br />31-208.2 AND 31-214, AS SEVERALLY AMENDED, OF THE CODE <br />OF THE CI1Y OF CHARLOTTESVILLE, 1976, IN ORDER TO MODIFY <br />THE ZONING AND LAND USE REGULATIONS OF THE CITY WITH <br />RESPECT TO THE DEFINITION OF SIGNS, NAMES OF ZONING <br />DISTRICTS; PERMISSIBLE HOME OCCUPATIONS; AREA PARKING <br />AND RECREATION REQUIREMENTS IN R~3 RESIDENTIAL DISTRICTS; <br />CONTENTS OF DEVELOPMENTS USES PERMITTED IN B-I, B-2 AND <br />B-3 BUSINESS DISTRICTS; OFFSETTING STORAGE REQUIREMENTS <br />FOR FILLING.IN FLOOD PLAINS; APPLICABILITY OF ARCHI- <br />TECTURAL DESIGN CONTROLS; MAINTENANCE OF PROPERTIES <br />SUBJECT TO DESIGN CONTROLS; STANDARDS FOR PARKING SPACES; <br />SIGNS ALLOWED WITHOUT PERMIT; SITE PLAN CRITERIA FOR <br />DRAINAGE LANDSCAPING, SIDEWALKS, CAR WASHES AND DUMPSTER <br />ENCLOSURES; AND ISSUANCE OF BUILDING PERMITS" was offered <br />and carried over to the next meeting for consideration. <br /> <br />PUBLIC <br /> <br /> Ms. Frances Johnson of the Westhaven Tenants' <br />Association, requested that a member of Council be <br />present when another survey is done of the heat-~in <br />Westhaven. Ms. Johnson also requested that Dr. Hall, <br />as Chairman of the Housing Authority, be present for the <br />survey. <br /> <br /> Ms. Joy Johnson of Westhaven also stated that the <br />heating and hot water problems have not been corrected. <br /> <br /> Mr. Gene Arrington, Deputy Executive Director of <br />the Housing Authority, stated that the problem with the <br />hot water was being worked on but there did not appear <br />to be a problem with the hea~ing system. <br /> <br /> A tentative survey date was set for ?:O0 a.m. on <br />Saturday, February 22nd. <br /> <br /> Dr. Joseph Mooney of Sunset Avenue, stated that <br />the issue of a playground for the 7th Day Adventist <br />Church was being appealed to the Board of Zoning Appeals <br />and asked if the church was required to wait until the <br />outcome of the appeal before using the property as a <br />playground. <br /> <br /> <br />
