216 <br /> <br />on the downtown mall: Dogwood Festival, Spring Arts Fair, <br />Food for Fun, and Old Fashioned Bargain Days. <br /> <br /> Responding to a question from Mr. Buck, Mr. Wiley <br />stated that that permanent vendors would be allowed to <br />rove on the designated days. <br /> <br /> Mr. Wiley stated that the City could not regulate the <br />number of vendors on side streets. <br /> <br /> Ms. Reynolds, representing the Children's Festival, <br />which operates the day of the Dogwood Parade on the <br />downtown mall, stated that her group consists of <br />approximately 14 - 16 non-profit groups, many of whom <br />would be interested in selling items. <br /> <br /> Mr. Hendrix noted that if the vending regulations are <br />suspended, business licenses would still be required for <br />profit vendors. <br /> <br /> On motion by Dr. Hall, seconded by Dr. Hall, Council <br />unanimously voted to suspend the vending regulations on <br />the following occasions on the downtown mall: Dogwood <br />Festival, Spring Arts Fairr Food for Fun, and Old <br />Fashioned Bargain Days. <br /> <br />STAFF REPORT: ACCEPTING STREET AND HIGHWAY IMPROVEMENT LIST <br /> <br /> Mr. Buck requested that the Planning Commission <br />review the list before approval by Council. <br /> <br /> Mrs. Gleason requested a staff report on the TSM <br />projects. <br /> <br />RESOLUTION: <br /> <br />RESTAURANT <br /> <br />GRANTING PERMIT FOR OUTDOOR CAFE FOR HARDWARE STORE <br /> <br /> Mr. Jay Levine, part owner of the Hardware Store <br />Restaurant, requested a renewal of the permit for an <br />outdoor cafe. Mr. Levine stated that City staff had been <br />worked with regarding the location of the cafe and it had <br />been placed in its previous location because of the <br />increased slope of the mall in front of the Hardware Store <br />Restaurant. <br /> <br /> Mr. Leonard Milgram, owner of the Milgram Building <br />which is located next door to the Hardware Store <br />Restaurant, stated that he had done extensive improvements <br />to his building which is blocked when the Hardware Store's <br />outdoor cafe is operating. Mr. Milgram stated that he did <br />not feel it was fair for the outdoor cafe to be placed in <br />its previous location. <br /> <br /> Mrs. Gleason noted that Council had previously <br />limited outdoor cafes to one per block and requested that <br />staff explore whether it would be possible to move the <br />outdoor cafe east of its previous location. <br /> <br /> Mr. Milgram recommended that a subcommittee be <br />appointed which could work on a solution to the problem. <br /> <br /> Mr. Levine stated that the restaurant is anxious to <br />open the cafe and would prefer that action be taken as <br />soon as possible. <br /> <br /> Mr. Barnes stated that he would also be interested in <br />staff investigating options before Council takes action. <br /> <br /> The resolution was deferred until the special meeting <br />scheduled for April 15th. <br /> <br /> <br />
