The Planning <br />Commission recommended that an overall study be conducted <br />and the first, the Meadowcreek area, had been completed. <br />Following this report, the Planning Commission developed a <br />list of drainage priorities and criteria used to arrive at <br />the list. The Planning Commission passed on the <br />recommended priority list to Council. After reviewing the <br />list Council requested that staff provide additional <br />information including: surveys of drainage programs in <br />other cities, cost sharing options, cost estimates and <br />benefits and the City's legal responsibilities. <br /> <br /> Mr. Roger Wiley, City ~ttorney, reviewed legal <br />considerations concerning'drainage. Mr. Wiley stated that <br />as a general principle, Council doe not have an absolute <br />responsibility to correct all drainage problems, but the <br />fact that the City owns a great deal of land gives rise to <br />some legal responsibility w~ich should be determined on a <br />case by case basis. Mr. Wi±ey stated that drainage <br />problems were viewed as the "common enemy" but that if <br />water is diverted onto other property by the City, the <br />City can have responsibility. Mr. Wiley stated that the <br />City could also correct drainage problems for which they <br />are not legally responsible for the "common good." <br /> <br /> Ms. Judith Mueller, Director of Public Works, stated <br />that a survey of policies in other cities found tht there <br />are very few written policies, but that it is an area of <br />emerging importance. <br /> <br /> <br />
