246 WHEREAS, Le Jud Land Trust has submitted an application for a special permit to use the structure and property at 503 16th Street~ N.W. as a sorority house with setback encroachments; and WHEREAS, following a joint public hearing before this Council and the Planning Commission, duly advertised and held on April 8, 1986, this Council finds that such use will conform to the standards set forth in Section 31-28.1 of the City Code and to the criteria applicable to special permits generally under Chapter 31 of the City Code; now, therefore, BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special permit is granted pursuant to City Code Section 31-28, as amended, to use the structure and property at 503 16th Street, N.W. as a sorority house with not more than 12 residents, identified on City Real Property Tax Map 5 as parcel 71, having approximately 7,833 square feet of land or .18 acres. Such use shall be carried out in accordance with the site plan as approved by the Director of Planning. BE IT FURTHER RESOLVED that, pursuant to Section 31-288.1 of the City Code, as amended, and as a condition of such special permit, the normal average setback requirement, including the encroachmen~ of 3 off-street parking spaces into the required side yard setback as indicated on the approved site plan, is waived. RESOLUTION: AGREEMENT AUTHORIZING MAYOR TO SIGN CITY/COUNTY/UNIVERSITY Mr. Hendrix stated that the Planning Commission had made some recommendations concerning the City/County/ University agreement which had been sent to all parties. Mr. Buck noted that should the other involved parties make changes in the agreement, it could be amended by Council at a later date. Mrs. Gleason stated that she felt the agreement had very positive advantages for the community and was a sign of more improvements in the future° On motion by Mr. Barnes, seconded by Mr. Barnes, the resolution authorizing the Mayor to sign the City/County/ University agreement was unanimously approved by Council BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the Mayor is hereby authorized to execute on behalf of the City the following document, in form approved by the City Attorney: Agreement among the City of Charlottesville, Albemarle County and the University of Virginia concerning land use planning. A copy of such document shall be kept on file with the minutes of the Council meeting at which this resolution was adopted. RESOLUTION: VEPCO AUTHORIZING CITY MANAGER TO SIGN AGREEMENT WITH Mr. Hendrix stated that the agreement was the result of negotiations between the Virginia Municipal League and Vepco and was standard throughout the State~ Mr. Barnes questioned whether the issue of requiring reasonable documentation of the expense for undergrounding utilities by Vepco could be addressed in the agreement.
