246 <br /> <br /> WHEREAS, Le Jud Land Trust has submitted an <br />application for a special permit to use the structure and <br />property at 503 16th Street~ N.W. as a sorority house with <br />setback encroachments; and <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and <br />held on April 8, 1986, this Council finds that such use <br />will conform to the standards set forth in Section 31-28.1 <br />of the City Code and to the criteria applicable to special <br />permits generally under Chapter 31 of the City Code; now, <br />therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that a special permit is granted <br />pursuant to City Code Section 31-28, as amended, to use <br />the structure and property at 503 16th Street, N.W. as a <br />sorority house with not more than 12 residents, identified <br />on City Real Property Tax Map 5 as parcel 71, having <br />approximately 7,833 square feet of land or .18 acres. <br />Such use shall be carried out in accordance with the site <br />plan as approved by the Director of Planning. <br /> <br /> BE IT FURTHER RESOLVED that, pursuant to Section <br />31-288.1 of the City Code, as amended, and as a condition <br />of such special permit, the normal average setback <br />requirement, including the encroachmen~ of 3 off-street <br />parking spaces into the required side yard setback as <br />indicated on the approved site plan, is waived. <br /> <br />RESOLUTION: <br /> <br />AGREEMENT <br /> <br />AUTHORIZING MAYOR TO SIGN CITY/COUNTY/UNIVERSITY <br /> <br /> Mr. Hendrix stated that the Planning Commission had <br />made some recommendations concerning the City/County/ <br />University agreement which had been sent to all parties. <br /> <br /> Mr. Buck noted that should the other involved parties <br />make changes in the agreement, it could be amended by <br />Council at a later date. <br /> <br /> Mrs. Gleason stated that she felt the agreement had <br />very positive advantages for the community and was a sign <br />of more improvements in the future° <br /> <br /> On motion by Mr. Barnes, seconded by Mr. Barnes, the <br />resolution authorizing the Mayor to sign the City/County/ <br />University agreement was unanimously approved by Council <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the Mayor is hereby <br />authorized to execute on behalf of the City the following <br />document, in form approved by the City Attorney: <br /> <br />Agreement among the City of Charlottesville, <br />Albemarle County and the University of Virginia <br />concerning land use planning. <br /> <br /> A copy of such document shall be kept on file with <br />the minutes of the Council meeting at which this <br />resolution was adopted. <br /> <br />RESOLUTION: <br /> <br />VEPCO <br /> <br />AUTHORIZING CITY MANAGER TO SIGN AGREEMENT WITH <br /> <br /> Mr. Hendrix stated that the agreement was the result <br />of negotiations between the Virginia Municipal League and <br />Vepco and was standard throughout the State~ <br /> <br /> Mr. Barnes questioned whether the issue of <br />requiring reasonable documentation of the expense for <br />undergrounding utilities by Vepco could be addressed in <br />the agreement. <br /> <br /> <br />
