248 <br /> <br /> Mr. Wiley noted that Mr. Craig Brown, Assistant City <br />Attorney, had been instrumental in reaching the agreement. <br /> <br /> On motion by Dr. Gunter, seconded by Mrs. Gleason, <br />the resolution authorizing the Mayor to sign the <br />settlemen~ with the Cherry Avenue Christian Church was <br />unanimously approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville that the Mayor is hereby authorized to <br />execute on behlf of the City the following document, in <br />form approved by the City Atorney: <br /> <br />Settlement Agreement between Cherry Avenue Christian <br />Church and City Council, City of Charlottesville in <br />connection with litigation involving Cherry Avenue <br />Christian Church. <br /> <br /> A copy of such document shall be kept on file with <br />the miutes of the Council meeting at which this resolution <br />was adopted. <br /> <br />ORDINANCE: CLOSING AN ALLEY OFF HARRIS STREET (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE CLOSING, <br />VACATING AND DISCONTINUING AN ALLEY OFF HARRIS STREET" <br />which was offered at the meeting of April 7th was approved <br />by the following vote. Ayes: Mr. Barnes, Mr. Buck, Dr. <br />Gunter. Noes: None. Abstaining: Mrs. Gleason. Absent: <br />Dr. Hall. <br /> <br />ORDINANCE: REZONING 524 LOCUST AVENUE FROM R-2 TO B-1 (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND <br />REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 <br />OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1976, AS AMENDED, BY THE REZONING OF <br />PROPERTY LOCATED AT 524 LOCUST AVENUE" was approved by the <br />following vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. <br />Gleason, Dr. Gunter. Noes: None. Absent: Dr. Hall. <br /> <br />ORDINANCE: AMENDING ZONING ORDINANCE RE: SPECIAL PERMIT FOR <br />PARKS AND PLAYGROUNDS IN R-1 AND R-2 ZONES (2nd reading) <br /> <br /> Mr. Wiley stated that the deletion of community <br />buildings which was made at the previous meeting would make <br />certain City-owned recreation buildings and parks non- <br />conforming uses and recommended that these be allowed by <br />right. <br /> <br /> Mr. Buck stated that he agreed with Mr. Wiley"s <br />recommendation because he felt that the City would review <br />the advisability of the City-owned recreation centers or <br />parks before allowing them. <br /> <br /> Mrs. Gleason moved to amend the ordinance as <br />recommended by Mr. Wiley, Mr. Barnes seconded the motion <br />and the ordinance was unanimously amended by Council. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND <br />REORDAIN SECTION 31-13, 31-14, AND 31-27, AS AMENDED, OF <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, RELATING TO <br />ZONING CLASSIFICATION OF PUBLIC OR PRIVATE PARKS, <br />PLAYGROUNDS AND COMMUNITY BUILDINGS," as amended, was <br />approved by the following vote. Ayes: Mr. Barnes, Mr. <br />Buck, Mrs. Gleason, Dr. Gunter. Noes: None. Absent: <br />Dr. Hall. <br /> <br />ORDINANCE: AMENDING ZONING ORDINANCE RE: APPLICABILITY TO THE <br />HISTORIC PRESERVATION & ARCHITECTURAL DESIGN CONTROL ORDINANCES <br /> <br /> Mr. Wiley explained that the ordinance would extend <br />control of the use of property in the historic districts <br /> <br /> <br />
