249 <br /> <br />or property designated as an historic landmark that may <br />be subdivided to the appropriate boards. <br /> <br /> Mr. Huja noted that the Histroic Landmarks Commission <br />and boards of architectural review were in favor of the <br />proposed ordinance. <br /> <br /> Mr. Wiley stated that the proposed o~dinance would <br />not prevent subdivision of the properties in question as <br />allowed by law. <br /> <br /> Mr. Barnes asked how many properties outside of the <br />historic districts would be affected. <br /> <br /> Mr. Huja stated that he would provide Council with a <br />list of properties by the next meeting. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND <br />REORDAIN SECTION 31-127.2, AS AMENDED, OF THE CODE OF THE <br />CITY OF CHARLOTTESVILLE, 1976, RELATING TO THE <br />APPLICABILITY OF ARCHITECTURAL DESIGN CONTROLS" was <br />offered and carried over to the next meeting for consideration. <br /> <br />ORDINANCE: AMENDING ZONING ORDINANCE RE: <br />PROPERTIES'IN DOWNTOWN CONTROL DISTRICT <br /> <br />MAINTENACE OF <br /> <br /> Mr. Wiley stated that the ordinance would give the <br />authority to the Downtown Board of Architectural Review to <br />regulate maintenance of buildings. Mr. Wiley stated that <br />he had previously questioned the City's authority to <br />regulate maintenance but a circuit court in a different <br />part of Virginia had upheld the legality of a similar <br />ordinance. <br /> <br /> Mr. Huja noted that the Board of Architectural Review <br />has been working successfully with property owners on this <br />issue and that the City has never been challenged legally. <br /> <br /> On motion by Dr. Gunter, seconded by Mrs. Gleason, <br />the ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 31-141, AS AMENDED, OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1976, RELATING TO MAINTENANCE OF PROPERTIES <br />SUBJECT TO DESIGN CONTROLS" was offered and carried over to <br />the next meeting for consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> A work session with the Planning Commission on the <br />Urban Design Program was scheduled for May 20th at 7:30 <br />p.m. <br /> <br /> On motion by Dr. Gunter, seconded by Mrs. Gleason, <br />Council voted to meet in executive session to discuss <br />personnel matters as exempted by Section 2.1-344(a)(1) <br />of the Virginia Freedom of Information Act. <br /> <br />was <br /> <br />adjourned. <br /> <br /> <br />
