252 ' <br /> <br /> Mr. Buck questioned the legality of the City <br /> controlling what is develoPed on the entrances into the <br /> City. <br /> <br /> Mr. Roger Wiley, City Attorney, responded that the <br /> City may need to change the Comprehensive Plan in order to <br /> have the ordinance apply to the entrances into the City. <br /> Mr. Buck recommended that staff study the enabling <br /> legislation for such controlS and added that he City might <br /> want to make recommendations for new legislation to the <br /> State. <br /> <br /> Mr. Wiley stated that under existing legislation the <br /> City could control some development but could not control <br /> building design. <br /> <br /> The ordinance was deferred until the property owners <br /> affected coUld be notified. <br /> <br />ORDINANCE: AMENDING ZONING ORDINANCE RE: MAINTENANCE OF <br />PROPERTIES IN DOWNTOWN CONTROL DISTRICT <br /> Mr. Hendrix stated that he had the same concern about <br /> notification of property owners for this ordinance.as he <br /> had with the previous one. <br /> <br /> The ordinance was deferred until the property owners <br /> affected could be notified° <br /> <br />ORDINANCE: AMENDING ORDINANCE RE: OIL BURNING EQUIPMENT <br /> Mr. Hendrix stated that the proposed change would <br /> shift the ordinance from one part of the code to another. <br /> Mr. Wiley stated that the only result from the change <br /> in the ordinance would be the enforcing parties. <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, <br /> the ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> ARTICLE III OF CHAPTER 11 OF THE CODE OF THE CITY OF <br /> CHARLOTTESVILLE, 1976, BY ADDING A NEW SECTION, NUMBERED <br /> 11-6.1, DELETING FROM THE CITY CODE ARTICLE 14, OIL <br /> BURNING EQUIPMENT, OF THE BOCA BASIC FIRE PREVENTION CODE, <br /> 1981" was offered and carried over to the next meeting for <br /> consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Hendrix stated that the State Transportation <br />Commission had recommended that the City rate <br />transportation projects as high, medium or low priority, <br />and noted that some of the projects on the City's list <br />were located in Albemarle County but impacted the City. <br /> <br /> It was the consensus of Council to accept the staff's <br />recommendation concerning the transportation priorities. <br /> <br /> Dr. Gunter recommended that the process of <br />coordination with the University made possible by the <br />City/County/University agreement begin with respect to the <br />Venable Neighbohood. <br /> <br /> Mr. Buck stated that he was concerned with beginning <br />the process before the County ratified the agreement. <br /> <br /> Dr° Gunter stated that she did not feel the area <br />affected would need to involve Albemarle County. <br /> <br /> <br />
