260 <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, <br /> Council unanimously voted to join the Rivanna Chapter of the <br /> National Railway Historical Society, Inc. in their request <br /> that the CSX Corporation not close the turntable and <br /> associated trackage until the Railway Historical Society and <br /> community representaives meet with CSX to discuss future <br /> plans. <br /> <br /> Mr. Buck requested that staff provide any information <br /> available concerning the legal responsibility of the CSX <br /> Corporation regarding the land. <br /> <br />PUBLIC HEARING: CABLE TV FRANCHISE ORDINANCE <br /> <br /> Mr. Roger Wiley, City Attorney, summarized the Cable TV <br /> franchise ordinance. Mr. Wiley stated that the ordinance <br /> would grant a five-year renewal franchise to Multi-Channel <br /> TV Company, operating as Jefferson Cable. Federal law <br /> restricts the authority granted to local governments, but <br /> the ordinance was written maintaining the maximum local <br /> control allowed by federal law. The ordinance includes <br /> monitoring activities and a certain degree of consumer <br /> protection. Mr. Wiley summarized the major sections of the <br /> ordinance as follows: 1) general provisions and an increase <br /> in fees from 3% to 5%; 2) location and installation of cable <br /> lines, with the presumption of replacing wires underground; <br /> 3) requirement of maintenance of existing systems and a <br /> commitment by the company to maintain a mix of channels; <br /> 4) rates and subscriber protection methods, with the preser- <br /> vation of the right to re-institute rate regulation if <br /> allowed by the courts; and 5) procedural matters and future <br /> renewal requests. <br /> <br /> Mr. Joe Price, Manager of Jefferson Cable, introduced <br /> representatives of Multi-Channel TV Company and requested <br /> renewal of the franchise, noting Jefferson Cable's state-of- <br /> the-art equipment and quality service. <br /> <br /> Mr. Paul Glist, an attorney for Jefferson Cable, <br /> requested that the ordinance be amended to allow Jefferson <br /> Cable to replace wires underground in the historic districts <br /> when the telephone lines are undergrounded, and to replace <br /> wires underground in other areas of the City when all other <br /> utilities go underground. <br /> <br /> As there was no one to speak, the public hearing was <br /> closed. <br /> <br /> Dr. Gunter stated that she had no objection to <br />Jefferson Cable's request concerning undergrounding, but she <br />felt it was important to continue moving toward <br />undergrounding utlities. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, <br />Council unanimously voted to amend the ordinance as <br />requested by Mr. Glist. <br /> <br /> On motion by Dr. Hall, seconded by Mr. Barnes, the <br />ordinance entitled "AN ORDINANCE GRANTING A RENEWAL <br />FRANCHISE TO MULTI-CHANNEL TV CABLE COMPANY TO OWN AND <br />OPERATE AND MAINTAIN A CABLE COMMUNICATION SYSTEM IN THE <br />CITY OF CHARLOTTESVILLE, VIRGINIA" was offered and carried <br />over to the next meeting for consideration. <br /> <br />PUBLIC HEARING: UTILITY RATES <br /> <br /> Mr. Tom Haden, Assistant Director of Finance, <br />summarized the proposed utility rates. <br /> <br /> Responding to a question by Mr. Barnes, Mr. Haden <br />responded that there were 47 interruptible gas customers. <br /> <br />As there was no one to speak, the public hearing was <br /> <br /> <br />
