On motion by Mrs. Gleason, seconded by Dr. Gunter, the ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTIONS 12-3, 12-6, 12-7, 24-2, AND 29-2, AS AMENDED, OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, RELAING TO CITY GAS, WATER AND SEWER CHARGES', was offered and carried over to the next meeting for consideration. APPROPRIATION: ADOPTING UTILITY BUDGET On motion by Mr. Barnes, seconded by Dr. Gunter, the Utility Budget Appropriation was offered and carried over to the next meeting for consideration. It was noted by Council that both the Utility Rate Ordinance and Utility Budget Appropriation are subject to modification following the work session. ORDINANCE: AMENDING CHAPTER 5.1 OF CITY CODE RELATING TO CABLE COMMUNICATIONS Mr. Wiley stated that the ordinance was being amended to comply with federal law and would include the provision that apartment complexes could not prohibit individual service to tenants within the complex and would clarify the law regarding receiving cable services without paying the necessary fees to the cable company. Mr. Barnes requested that staff examine Section 5.1-2.1.1 and clarify the language. On motion by Mrs. Gleason, seconded by Dr. Hall, the ordinance entitled "AN ORDINANCE TO AMEND CHAPTER 5.1 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976 RELATING TO CABLE COMMUNICATIONS SYSTEMS BY AMENDING AND REORDAINING SECTIONS 5.1-1, 5.1-6~ 5.1-7 AND 5.1-9, REPEALING SECTIONS 5.1-2, 5.1-3~ 5.1-4, 5.1-5, AND 5.1-8, AND ADDING NEW SECTIONS NUMBERED 5.1-2.1 AND 5.1-8.1 AND 5ol-9.1" was offered and carried over to the next meeting for consideration. PRESENTATION: GRAPHICS AWARD - "BUS GUIDE" - TRANSIT SERVICE Mr. Buck presented a plaque to Ms. Helen Poore and Mr. Harold Grimes of the Transit Service and Mr. Jim Herndon of Community Development, for an award for second place in a national graphics competition for the Bus Guide. REQUEST: ISRAEL CONVEYING BETH ISRAEL CEMETERY TO CONGREGATION BETH Mr. Hendrix stated that the Congregation Beth Isreal had requested that the City reconvey the Hebrew Cemetery to the Congregation. Mr. Hendrix stated that the deed would provide that the City return $4,000 which the Congregation had contributed previously for a perpetual care fund and provided that the Congregation would add 10% of the proceeds from sales of plots in future years to the perpetual care fund. Mr. Hendrix stated that staff had no objection to reconveying the cemetery to the Congregation Beth Israel. On motion by Dr. Gunter~ seconded by Dr. Hall, the ordinance entitled "AN ORDINANCE TO AUTHORIZE THE RECONVEYANCE OF A CEMETERY, KNOWN AS HEBREW CEMETERY, LOCATED ON THE EAST SIDE OF FIRST STREET IN THE CITY OF CHARLOTTESVILLE TO THE TRUSTEES OF THE RELIGIOUS CONGREGATION OF BETH ISRAEL TEMPLE OF CHARLOTTESVILLE, AND TO RETURN TO THE CONGREGATION $4,000.00 IN PERPETUAL CARE FUNDS" was offered and carried over to the next meeting for consideration.
