desiring to dispose of asbestos materials should pay a <br />charge to defray these added expenses; now, therefore be <br />it <br /> <br /> RESOLVED by the Council of the City of <br />Charlottesville, Virginia that all persons depositing <br />material containing asbestos, at the Ivy Landfill shall <br />pay a handling charge of $.03 per pound or $60.00 per ton <br />of such material; and be it <br /> <br /> RESOLVED that the Board of Supervisors of the County <br />of Albemarle is requested to concur in the imposition of <br />this change. <br /> <br />RESOLUTION: <br /> <br />SQUARE" <br /> <br />GRANTING A SPECIAL PERMIT FOR "QUEEN CHARLOTTE <br /> <br /> Mr. Satyendra Huja, Director of Community <br />Development, reviewed the "Queen Charlotte Square" <br />proposal and stated that the Planning Commission <br />recommended approval for the following reasons: 1) It is <br />in harmony with the proposed uses in the Land Use Plan of <br />the Comprehensive Plan; 2) It will not have a significnt <br />adverse impact on the surrounding neighborhood and area, if <br />conditions are met; 3) The proposal is compatible with <br />surrounding buildings and uses; 4) The proposed setback <br />modifications are in keeping with the intent of the City <br />Code. Mr. Huja stated that the approval by the Planning <br />Commission was conditioned upon the following: 1) Admin- <br />istrative approval of the site plan with the following <br />changes/additions: measures to protect trees being saved <br />and complete details on proposed recreational space <br />requirements in special permits for higher density; 2) A <br />grading and soil erosion/sediment control plan will have <br />to be submitted for review and approval prior to final <br />site plan approval. This should include linear dimension <br />on curbing and sidewalks; and 3) Modifications of the <br />southwest corner of the Phase II building to better relate <br />to Lee Park. <br /> <br /> Mr. Wiley stated that if the developer intended to <br />build the project in two phases, then the resolution would <br />need to be changed to reflect that. <br /> <br /> Mr. William Daggett, developer of the proposed <br />project, stated that if market response is strong, he <br />preferred to build the project in one phase, but economics <br />might dictate building it in two phases. Mr. Daggett <br />stated that should the project be built in two phases, <br />then only one parking level at a time would be built. <br /> <br /> Mr. Buck stated that he felt the location of the <br />project, close to the downtown mall and downtown parks, <br />balanced the usual recreation requirements and he <br />recommended that the recreation requirements be totally <br />waived. <br /> <br /> It was agreed that only one level of parking would be <br />required should the project be built in two phases, <br />subject to approval of the site plan and design. <br /> <br /> On motion by Mr. Barnes, seconded by Dr. Gunter, the <br />resolution granting a special permit for "Queen Charlotte <br />Square" was unanimously approved by Council <br /> <br /> WHEREAS, Bosworth Parks Development Corporation has <br />submitted an application for a special permit for a <br />propbsed higher density residential and commercial <br />development on the property comprising the city block <br />bounded by Jefferson, Third, High and Second Streets, <br />N.E.; and <br /> <br />WHEREAS, such application has been duly advertised, <br /> <br /> <br />
