272 <br /> <br />and has been the subject of a joint public hearing before <br />this Council and the Planning Commission on June 10, 1986, <br />and the concept of development has been considered by the <br />Board of Architectural Review, all as provided by law; and <br /> <br /> WHEREAS, the granting of the special permit has been <br />recommended to Council by the Planning Commission; now, <br />therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlotteville, Virginia that: <br /> <br /> 1. A special permit is hereby granted pursuant to <br />Section 31-28 of the City Code, for development of such <br />property at a maximum residential density of 36 units, or <br />34.28 units per acres. The Council finds and declares <br />that the proposed project is in substantial compliance <br />with the standards and requirements for such residential <br />higher density special permits set forth in Section 31-33, <br />and with the criteria applicable to special permits <br />generally under Chapter 31 of the City Code. This permit <br />is hereby expressly conditioned upon development of the <br />property in conformity with the standards and requirements <br />of Section 31-33 of the City Code, unless modified or <br />excepted herein. <br /> <br /> 2. Pursuant to Section 31-288 of the City Code, <br />modifications are hereby granted to the required yard <br />setbacks normally applicable in B-1 Business Districts. <br />As applied to the subject property the following setback <br />modifications are granted: <br /> <br /> 11 feet on East Jefferson Street, 11 feet on East <br />High Street, 1 - 5 feet on Second Street and 1 - 5 feet on <br />Third Street. Also pursuant to Section 31-228.1 of the <br />City Code, the standard for recreational space for higher <br />density residential developments, as stated in Section <br />31-33 of the City Code is hereby modified to the extent <br />that the features shown on the site plan fail to meet the <br />required 4,130 square feet of recreational sapace. This <br />Council finds and declares that these modifications are in <br />harmony with the purposes and intents of Articles IV, IX <br />and XX of Chapter 31 of the City Code, under which the <br />foregoing special permit and modifications are being <br />sought, and further finds and declares that such <br />modifications are necessary and desirable in view of the <br />nature, circumstances and location and situation of the <br />project proposed for such property. Such modifications <br />are hereby imposed as specific conditions of the foregoing <br />special permit, and the project shall be developed in full <br />conformity therewith. <br /> <br /> 3. The special permit and modifications shall be <br />carried out in accordance with the site plan as approved <br />by the Dirctor of Planning, and are conditioned upon <br />mOdification of the corner of the building at the <br />southwest corner of the property to better relate to Lee <br />Park. <br /> <br /> 4. Notwithstanding the foregoing requirements, the <br />project proposed for the property may be carried out in <br />two phases, with one phase consisting of the building(s) <br />fronting on High Street and their required parking spaces, <br />and the other phase consisting of the building(s) fronting <br />on Jefferson Street and their required parking spaces. <br />Either phase may proceed to development without the other. <br />In the event construction of the second phase of the <br />development does not commence within two years of the <br />adoption of this permit, the property owner shall submit <br />an amended site plan to provide additional landscaping and <br />appropriate screening on the undeveloped portion of the <br />property. <br /> <br /> <br />
