• Since the City's position will, in my opinion, be
dependent upon the facts and the exercise of business judgm(
as well as the law involved, I recommend that a Committee bE
appointed consisting of some member of the Council, the Cita
Manager and City Attorney, with instructions to matie rel_l-ort
the earliest practical date.
Respectfully submitted,
E. V. WALKER (signed)
EVVd/IA City Attorney
In accordance with the foregoing report a committee, consisting of Dr. Haden,
the City Manager and City Attorney, was appointed.
The following report was unanimously adopted:
October 17, 1938
Council of the City of Charlottesville,
Charlottesville, Virginia.
RE: Farmers Cooperative Merchants License
Gentlemen:
°O You will recall that the above matter has been under
n
cv consideration by the Council for someti,-.e and have no doubt seen
-• quite recently that the City of Harrisonburg has been successful
Report re: before the Court of Appeals of Virginis in assessing a License
Cooperative Tax on such subjects in that City.
Merchuntst
License Following the newspaper announcement of the above
decision, I wrote the City Attorney of Harrisonburg for a copy of
the briefs in the Appellate Court and herewith attach copy of his
reply.
In view of the fact that the Commissioner of taxation,
Ir. Morrissett, is now seeking to obtain information from the
Court of Appeals which will clarify the decision and enable him to
collect State Tax from all such tax subjects in the State, I
recommend that the City's action in this matter be deferred for
a reasonable time so that the City will be able to act in con-
junction with the State which will undoubtedly have many advantages.
Very truly yours,
E.
