WALKER (signed) <br />EVVd/IA City Attorney <br />In accordance with the foregoing report a committee,consisting of Dr. Haden, <br />the City Manager and City Attorney, was appointed. <br />The following report was unanimously adopted: <br />October 17, 1938 <br />Council of the City of Charlottesville, <br />Charlottesville, Virginia. <br />RE: Farmers Cooperative Merchants License <br />Gentlemen: <br />°O You will recall that the above matter has been under <br />�n <br />cv consideration by the Council for someti,-.e and have no doubt seen <br />�-• quite recently that the City of Harrisonburg has been successful <br />Report re: before the Court of Appeals of Virginis in assessing a License <br />Cooperative Tax on such subjects in that City. <br />Merchuntst <br />License Following the newspaper announcement of the above <br />decision, I wrote the City Attorney of Harrisonburg for a copy of <br />the briefs in the Appellate Court and herewith attach copy of his <br />reply. <br />In view of the fact that the Commissioner of taxation, <br />Ir. Morrissett, is now seeking to obtain information from the <br />Court of Appeals which will clarify the decision and enable him to <br />collect State Tax from all such tax subjects in the State, I <br />recommend that the City's action in this matter be deferred for <br />a reasonable time so that the City will be able to act in con- <br />junction with the State which will undoubtedly have many advantages. <br />Very truly yours, <br />E.
