within the corporate limits. Any person having charge of such
<br />locomotive, who shall violate the provisions of this section shall
<br />be fined not less than $2 nor more than $5.
<br />Sec. 596. Steam railroads—flagmen.
<br />Every steam railroad company, whose tracks are located within
<br />the city, shall station at such points along the line of said tracks
<br />as have been or may hereafter be designated by the Council, a
<br />sufficient number of flagmen, who shall be provided with flags
<br />in the clay time, and lanterns at night, and whose duty it shall be
<br />to prevent accidents by giving clue notice of the approach and
<br />passing of trains and locomotives. Any railroad company failing
<br />to comply with this section shall pay a fine of not less than $10
<br />nor more than $50 for each clay such default shall continue; and
<br />should any flagman, through absence from his station, or other-
<br />wise, fail to properly discharge his duties on the approach or pass-
<br />ing of any train or locomotive, the railroad company owning or
<br />controlling such locomotive shall pay a fine of $5 for each offense.
<br />Sec. 597. Flagmen—to be appointed special policemen.
<br />It shall be the duty of the Mayor of the city to appoint and
<br />empower as special policemen, without salary from the city, all
<br />persons employed as flagmen, whose names shall be furnished to
<br />the Mayor by the company so employing them. But such police
<br />authority shall terminate whenever said persons cease to be em-
<br />ployed as flagmen, or at any other time that the Mayor may
<br />deem it proper to revoke said authority.
<br />Sec. 598. Locomotives—riding or driving in front of, etc.
<br />It shall be unlawful to ride or drive in front of any moving
<br />trjitr e r locomotive within less than fifty feet; or to ride or
<br />drive within the guard gates at any railroad crossing while the
<br />said gates are clown or being lowered; nor shall any person except
<br />an employee of the railway company get on or off a train in mo-
<br />tion. For a violation of any provision of this section the penalty
<br />shall not be less than $2 nor more than $10.
<br />Sec. 599. Loitering or trespassing upon tracks or plat-
<br />form.
<br />It shall be unlawful for any person to play or loiter about or
<br />brakes and fenders. For any violation of this section the owner
<br />of such car shall be fined $25 for each offense.
<br />Sec. 604. Same—care to be numbered.
<br />Each street car running upon the road shall be numbered, and
<br />its number conspicuously painted upon each side or end thereof.
<br />For a breach of this section, the owner shall be fined $5 for each
<br />day it continues.
<br />Sec. 605. Motormen and conductors to be special police.
<br />All motormen and conductors of street cars, for the purpose
<br />of enforcing order, peace and good behavior upon their respective
<br />cars, are hereby constituted and appointed special policemen, and
<br />for that purpose are endowed with all the powers and are held
<br />to the same responsibilities as other policemen of the city, and
<br />shall qualify in same manner as other policemen.
<br />Sec. 606. Spitting on street cars—smoking.
<br />No person shall spit on the floor, seats, or any part of any street
<br />car operated in this city, nor shall any person smoke on any such
<br />car or the side platforms thereof. Any person violating this sec-
<br />tion shall be fined $2 for each offense.
<br />Sec. 607. Unlawful to jump on or off moving cars.
<br />It shall be unlawful for any person, not an employee of the
<br />company, to attempt to get on a street car or in any way hang on
<br />the sides thereof, for the purpose of riding without paying; or
<br />for a minor under fifteen years of age to jump on or off cars
<br />while in motion. For a violation of this section, the penalty shall
<br />not be less than $1 nor more than $5; and when the person so
<br />offending is under fifteen years of age the said fine shall be as-
<br />sessed against and paid by his parent or guardian.
<br />5 Sec. 608. Riding on running boards or steps on sides of
<br />g summer cars on street railway prohibited.
<br />It shall be unlawful to permit any passenger to ride on the
<br />running boards or steps on the sides of summer cars on any
<br />M i street railway. For every violation of this section, the company
<br />guilty of the misdemeanor shall be fined not less than $5.
<br />upon the railroad tracks or upon the platforms of the passenger
<br />depots, or about the railroad shops in the city. :any person vio•
<br />lating this section may be ordered to desist by any special or reg.
<br />ular policeman, and upon his failure to do so, he may be arrested,
<br />and, if convicted, shall be fined not less than $1 nor more than $S,
<br />provided, however, that nothing herein contained shall be eoe
<br />strued as to interfere with persons who are traveling, or
<br />friends meeting or accompanying such persons.
<br />Sec. 600. Street railway—shall not be impeded.
<br />No person shall obstruct or impede the running of the street
<br />cars. The driver of any vehicle met or overtaken by any street
<br />car shall turn off from the track as soon as notified so to do bf
<br />the bell or gong of the said street car, provided such vehicle u
<br />not over thirty yards from such car. Any one violating $4
<br />section shall be fined $5.
<br />Sec. 601. Same—motormen to warn drivers, etc.
<br />The motorman on every electric car run in the city shall gin
<br />ample' notice of the approach of the car upon which he is serving,
<br />to the drivers of other vehicles and pedestrians upon the trach
<br />in front of him, by sounding the gong or bell upon said at;
<br />every such motorman shall further distinctly sound such gal
<br />or bell at least one hundred feet f rom any street which his car h
<br />to cross, and shall continue to so sound it from that point Hatt
<br />said car has crossed said street. For every violation of this sec.
<br />tion, the fine of $2 shall be imposed upon said motorman and a
<br />further fine of $5 upon the corporation or individual owning and
<br />running said car.
<br />Sec. 609. Same—fire alarm.
<br />When a fire alarm is sounded, all street cars on the track shall
<br />be quickly moved to some point sufficiently distant from stied
<br />corners to prevent danger of collision with the fire apparatus, sad
<br />shall there be held until said fire apparatus has passed, provided
<br />that the delay shall not exceed five minutes.
<br />Sec. 608. Same—brakes and fenders.
<br />The cars used on street railways shall be pr-)vI(Iol with proper

<br />Sec. 609. Use and collection of fines.
<br />All fines imposed under any ordinance of tete city shall be for
<br />the use of the city. When imposed the offender may be Co
<br />nutted and the fines may be collected by execution directed to the
<br />Chief of Police or Constable of the city and returnable in fifteea
<br />days before the Police Justice. The officer levying shall sell the
<br />article levied on, for cash, before the City 1 fall after three days
<br />notice posted at the City Hall door.
<br />Sec. 610. Failure to pay fine—imprisonment.
<br />Any one against whom a fine is adjudged may be confined m
<br />jail by the order of the Police Justice, or other magistrate iO
<br />posing the same, until such fine is paid; provided, that no tern
<br />of imprisonment for the non-payment of a fine shall exceed three
<br />months.
<br />Sec. 611. Fines—how paid to informer.
<br />Although § 294 of these ordinances allows the informer
<br />e
<br />certain cases to receive one-half of the cash fines collected,
<br />do
<br />whole thereof shall go to the city, unless the informer m

<br />written claim to the Police Justice for such part of the fine at the
<br />time the warrant or process is issued against the accused.
<br />Sec. 612. Fines—when not provided for --how Wolod
<br />In any of these ordinances where no specific penalty is stated
<br />any person or corporation violating the same shall be fined n$
<br />less than $1 nor more than $20 for each offense.
