v Vv <br />AN ORDINANCE AT.TNDING SECTION 556 of CITY CODF,ENTITLFD , "FIRF DFPARTMFNT--ccntrol and supervision" <br />The fire department of the City of Charlottesville shall be under the control at <br />the Committee on Fire Department of the City Council,subject onlyto the sllpervieion <br />of the: Council. All drivers , enginemen and other persons in the employ of the Fire <br />Department shall be elected by the Fire Company at its August meeting and such electi, <br />shall be forthwith reported to the Fire Committee to be presented to the City Council`' <br />together with; the salaries to be paid,for conf rnation or rejection at its Septe ber <br />meeting. In event the Council rejects any or all of the persons so elected,said <br />Council shall at once proceed to elect. In event of a vacancy the Fire Comittee <br />shall fill the: same by appoi.ntr:ent,tht appointee to serve till the next regular <br />Meeting of tl,e Fire; Company when said company shall elect a person to fill such <br />vacancy and present his narne to the Council for confirmation or re j ection,as above, <br />Such persons or employees shall Mold their positions for the term of one year (except <br />when filling a vacancy the term shall be for the unexpired time of his predeceeBor), <br />or until severally removed Ly the Committee. The said cow, it©e,sh.all,subject to <br />the provisions of these ordinaarces,have full power to provide supplies,toole and <br />instruments, and apparatus of any and all kinds incident to or to be used in the <br />control,prevent ion and extinguishing of fires, and to buy, sell, construct and repair <br />and have the care of the same, and to take any and all such action in the premises <br />as it may deem to be reasonatly necessary and proper. <br />Council April 14,1910. Said ehie f and assistant and <br />the police officers of the city, shall exclude from, and prevent tti- e interference of <br />all persons at buildings and grounds a4jacent thereto,dvring a fire and no person shall <br />have the right to enter within the ropes surrounding such fire,except owners of props <br />thereat,or such other persons as may o!,tain permission of the chief or his assistant, <br />Said officers shall have authority to take into custody all persons persisting in <br />any irilrerfererrce with ti,;;-, work of tl,e fire company; and upon conviction of at -,y person <br />so offending shall be fined not less than $5. It shall be the duty of the chief,or <br />whoever shall act as such,to keep a record of all fires,their place and time of <br />occurrence, arid shall obtain, if posuible,the cause of ouch fire,tl!e amount of insuraW, <br />if any, and actual loss; and said record shall at all times be kept open for inspecticl <br />of members, of the Council. Said chl.ief shall deliver to his successor in office said <br />records pertaining to the f ire department which may be in his control. <br />a. For the purpose for which the department exists ,the c1l { of shall have full super", <br />sion of 311 apparatus pertaining to the fire department, <br />b. All orders deemed necessary by the fire committee for the Food of t�!c department <br />shall be issued through the chief or hie assistant ,to the employees or subordinateW' <br />if the chief or his assistant refuses or neglects to communicate such orders by postiGl <br />or otherwise as the said committee may direct ,then the fire committee may issue its <br />notice in its own way. <br />c. Any charges preferred in writing; against the chief or t1 -,e assistant chief by thy <br />city council cr the fire committee, for ncn-performance of duty,sh.-all be brought bef0l' <br />the fire company for action at its next meeting not less than ten days after such <br />charges are preferred; the act ion of the fire company in the premises must be referre <br />to the council at its next regular meeting for confirmation or further ir.vestigaticn <br />or proceedings therein.
