AN ORDINANCE To extend the corporate limits of the City of Charlottesville in pursuance of the
<br />
<br />provisions of an Act of the General Assembly of Virginia approved March 10, 1904 entilted
<br />
<br />"An Act to provide for the extension of the Corporate Limits of Cities and Towns", as
<br />
<br />amended by two several Acts aprroved respectively on the 14th of March,1906, and
<br />
<br />February 9th,1912.
<br />
<br />BE IT ORDAINED, by the Council of Charlottesville:
<br />
<br />1. That the City of Charlottesville deems it desirable and hereby declares that it
<br />
<br />desires to annex in the manner prescribed by law, certain territory of the County of
<br />
<br />Albemarle, Virginia, adjacent to the; present corporate limits of the City of Char-
<br />
<br />lottesville.
<br />
<br />2. The territory of the County of Albemarle, Virginia, proposed to be acquired by
<br />
<br />this ordinance may be accurately described by the following metes and bounds--
<br />
<br />Beginning at a point at the intersection of the Southrtly right-of-way line of
<br />
<br />the Soutrern Ry. and Jefferson Park Ave. or Fry's Spring Road, thence along said
<br />
<br />Southern Railway's right-of-way line N.71 - 12 F. 1510 ft. to a stake, thence N. 73.
<br />
<br />55 E. 250 ft. to a stake, thence N. 71 - 11 E. 580 ft. to a stake, thence N. 71 - 49
<br />
<br />E. 1950 ft. to a stake, thence leaving said Southern Ry. right-of-way S. 1 -59 E.
<br />
<br />209 ft. to cast iron monument in the South side of grove St. , Fifeville, (This being
<br />

<br />3. The City of Charlottesville hereby sets forth the necessity for and expediency of
<br />
<br />the proposed annexation, the terms and conditions upon which the same is to be made
<br />
<br />and what it proposes for the future management of the annexed territory- that is to say.
<br />
<br />(1) The territory within the prasont limits is closely built crowded and congested,
<br />
<br />and it is both expedient and necessary that sufficient territory, suitable for building
<br />
<br />purposes/ may be added thereto so as to afford, at a moderate price, desirable locations
<br />
<br />for the erection of commodious, healthfu, and convenient residences.
<br />
<br />(2) The territory proposed to be anntxed is essentially part of the community known
<br />
<br />by the name of Charlottesville, the dwellers therein, with almost no exception, the
<br />
<br />transact business in Charlottesville, receive, to a considerable extent, already
<br />
<br />bentfits of the municipal conveniences of Charlottesville, in the way of streets,
<br />
<br />schools, fire and police protection, in addition to the advantages of being in such
<br />
<br />close proximity to the established center of trade of Albemarle County that they may
<br />
<br />readily obtain such comforts and necessities as are not so easily obtained under a
<br />
<br />different condition, and being so situated they receive these benefits without
<br />
<br />furnishing material contribution to the support of the municipality which furnishes
<br />
<br />such benefits.
<br />
<br />(3) The territory proposed to be annexed is already to a large extent built up with
<br />
<br />streets and alleys established, and it is both expedient and necessary that in the
<br />
<br />present protective system of public improvements of the city by the establishment of
<br />
<br />grades of streets and alleys, the construction of sewers culverts, drains water just,
<br />
<br />gas mains, and the like, these improvements and conveniences may be so, made and, _
<br />
<br />as as to avoid the unnecessary annoyance and damage which would be unavoidable where
<br />
<br />such territory is fully developed and built up before such improvements and convenien-
<br />
<br />ces shall be laid out and established -- it being a fact the city has recently voted
<br />
<br />a $26,000 bond issue for the purpose of extending its gas mains, and to improve and
<br />
<br />enlarge the plant, whereby such extensions may be properly carried out.
<br />
<br />(4) The part of the territory to be annexed is already built up without any safe
<br />
<br />or adequate system of sewers, or other sanitary conveniences, and this condition
<br />
<br />constitutes a menace to the health of the community, which renders it imperatively
<br />
<br />necessary that a complete system of sewerage be establsihed in connection with that
<br />
<br />mantained in the present corporate limits, and carefully kept in sanitary condition.
