A RESOLUTION EXEMPTING CITY OF CHARLOTTESVILLE BONDS FROM TAXATION WHEN HELD BY ANY <br /> <br />BANK OF THIS CITY. <br /> <br />RESOLVED, BY THE COMMON COUNCIL, THE BOARD OF ALDERMEN CONCURRING, <br /> <br />That the bonds of the City Charlottesville held by any of the banks of the city <br /> <br />be deducted from tre taxable value of their respective stocks when assessment is made <br /> <br />for city taxes; the book value at which any bonds are held shall be the basis of <br /> <br />deduction. <br /> <br />Adopted by the Common Council Dec. 20, 1921. <br />Ayes: Forrest, Quarles, Morris, Twyman, Via, Whitten and Watson <br />Concurred in by Board of Aldermen January 18, 1922 <br />Ayes: Greaver, Haden and Walker <br /> <br />Presented and approved January 19, 1922 <br /> <br />Mayor Signature. <br />Clerk Signature. <br />President Common Council Signature. <br />President Board of Aldermen Signature. <br /> <br /> <br /> <br />Sec. I. The City of Charlottesville a in consideration of the public interests and of the <br /> <br />benefit and advantage to accrue from certain improvements to be made by the Chesapeake <br /> <br />and Ohio Railway Company in connection with increasing its yard facilities and other <br /> <br />proposed railroad construction and in consideration of the undertakings of the said <br /> <br />Railway company hereinafter contained, does hereby consent and agree that the said <br /> <br />Cheasapeake and Ohio Railway Company may and shall have the right and hereby gives, <br /> <br />grants and confirms unto the said Cheasapeake and Ohio mailway Company the right <br /> <br />(a) To change the location of Lyman Street as the same is now located card maintained <br /> <br />so that begining at a point in the intersection of said Lyman Street and Monticello <br /> <br />Road the southern boundary of said Lyman Street shall be about fifteen feet south of <br /> <br />the present bound of said street and continuing practically parallel to the present <br /> <br />lines of said street until at the intersection of said Lyman Street and Douglas Avenue <br /> <br />the southern boundry of said Lyman street shall be fifty feet south of the present <br /> <br />southern boundary ofsaid street according to a map or plat made by the chief engineerle <br /> <br />office of the Chesapeake and Ohio Railway Company, dated. ?'ay 17,1916, drawing number <br /> <br />3632 a, which map or plat scows proposed changes in tee yards of the Chesapeake and 8hio <br /> <br />Railway Company and also the proposed changes in Lyman Street, which plat is hereto <br /> <br />attached and made part of this ordinance for the purpose of showing accurately the new <br /> <br />location of Lyman Street. <br /> <br />(b) The Chesapeake and Ohio Railway Company is hereby authorized, and does by its <br /> <br />acceptance of the provisions of this ordinance undertake and agree to make any changes <br /> <br />which may be nedessary to effect the relocation authorized in subdivision (a) of this <br /> <br />section, it being understood and agreed that the Chesapeake and Ohio Railway Company <br /> <br />is to relocate said Lyman Street as hereinablve specified, and to grade such re -located <br /> <br />street so as that the same shall be accessible to public travel from Douglas Avenue, <br /> <br />Goodman Street and Monticello Road; all work done hereunder to be under the supervision <br /> <br />of the City Manager. <br /> <br />The s aid Chesapeake and Orio Rail way Company shall however and is hereby required <br /> <br />a., its entire expense and cost to do all the work above set fort,. <br /> <br />(c) The City of Charlottesville hereby agrees to accept from the Chesapeake and <br /> <br />Ohio Railway Company without expense to said City a strip of land along the lines above <br /> <br />set forth sufficient to change the present location of Lyman Street to tee location <br /> <br />specified in subdivision (a) of tris ordinance, said Chesapeake and Orio Railway Company <br /> <br />without expense to said City to make any duds or other conveyance required at any time <br /> <br />by said city to Five a good title to the City of Charlottesville to said strip of land. <br /> <br />(d) The City of Charlottesville hereby agrees to convey, without expense to said <br /> <br />City, to the Chesapeake and Ohio Railway Company in consideration of the Chesapeake and <br /> <br />Ohio railway Company furnishing the land for the new location of said street and doing <br /> <br />the work necessary to change the present location of Lyman Street to tee location <br /> <br />proposed in subdivision (a) of erection I of this ordinance, the land formerly embraced <br /> <br />in Lyman Street as originally laidout, save and except such portion of the original <br /> <br />street as may be embraced in the new street as proposed to be located and the mayor of <br /> <br />the City of Charlottesville is hereby authorized and directed to make such contract and <br /> <br />conveyance to the Chesapeake and Ohio Railway Company at any time the Chesapeake and Ohio <br /> <br />Railway Company shall require, as shall carry out the purpose of this ordinance. <br /> <br />Sec.II. Lyman Street as hereby relocated shall extend from its present intersection <br /> <br />with Monticello road at a point about fifteen feet south of the former southern boundary <br /> <br />of said street between parallel lines with the same width as the former street, <br /> <br />to -wit: thirty feet, to its intersedtion with rouglas Avenue, at which point of <br /> <br />intersection with rouglas Avenue, it shall be fifty feet south of the former southern <br /> <br />boundary of said street. <br /> <br />The Chesapeake and Ohio Railway Company is permitted to lay their side-track <br /> <br />across Lyman Street as re -located as shown on the plat hereto attached <br /> <br />Adopted by the Common Council Jan. 12, 1922 <br />Ayes: Ellington, Forrest, Quarles, Morris, Twyman, Via, Whitten and Watson. <br />Concurred in by Board of Aldermen January 18, 1922 <br />Ayes: Greaver, Haden and Walker <br /> <br />Presented and approved January 19, 1922 <br /> <br />Clerk Signature. <br />President Common Council Signature. <br />President Board of Aldermen Signature. <br />
