<br />beginning, the aforesaid crossing at the center line of the Southern Railroad
<br />being one thousand one hundred and thirty-five feet east of milepost one
<br />hundred fourteen on the Southern Railroad.
<br />Thence south twenty degrees forty-nine minutes east four hundred thirteen
<br />and six -tenths feet to a marker; thence south forty -degrees thirty-five minutes
<br />east, one thousand six hundred sixty-one and two-tenths feet to a marker
<br />approximately two hundred feet south of the present end of Monte Vista Avenue,
<br />said last line crossing the Old Lynchburg Road (Hardware Road) at nine hundred
<br />eighty feet from its beginning; thence north sixty-four degrees twenty-nine
<br />minutes east, one thousand six hundred eighty-two and seven -tenths feet to a
<br />marker on the south side of the Harris Road approximately four hundred feet
<br />east of its intersection with Jefferson Park Avenue extended.
<br />Thence north fourteen degrees fifty-four minutes west one thousand three
<br />hundred five and nine -tenths feet to a marer, said line crossing Harris Road
<br />at one hundred eighty feet from its beginning.
<br />Thence along the south and east side of Cherry Avenue being parallel thereto
<br />and approximately one hundred fifty feet-ierefrom the following courses and
<br />distances: (1) north twenty-three degrees eight minutes east, one thousand twelve
<br />and two-tenths feet to a marker; (2) north forty-seven degrees forty-eight
<br />minutes east, eight hundred thirty-eight and one-tenth feet to a marker; (3) north
<br />fifty-seven degrees fourteen minutes east, three hundred forty-three and six -
<br />tenths feet to a marker; (1+) north fifty-nine degrees forty-two minutes east,
<br />one hundred ninety-seven.and seven -tenths feet to a mar<ier; (5) north sixty-
<br />eight degrees thirty-nine minutes east, one hundred sixty-two and eight -tenths
<br />feet to a marker; (6) south eighty-seven degrees seven minutes east, two hundred
<br />one feet; (7) south eighty-four degrees thirty-five minutes east, three hundred
<br />thirty-four and four -tenths feet to a marker; (8) north eighty-five degrees fifty-
<br />five minutes east, one hundred eighty-six feet to a marker; (9) north seventy-
<br />seven degrees sixteen minutes east, two hundred thirteen and eight -tenths feet
<br />to a marker; (10) north forty-one degrees thirty-one minutes east, one thousand
<br />one hundred twenty-one feet to a marker; (11) north thirty-eight degrees fifty-
<br />eight minutes east, two hundred fourteen feet to a marker on the present city
<br />boundry approximately two hundred seventy feet south of Cherry Avenue at its
<br />Intersection with Spring Street.
<br />Thence with the present city boundry south twenty-nine degrees thirty minutes
<br />east, three thousand one hundred seventy-six and six -tenths feet to the point of
<br />beginning near the south end of Ridge Street, the grounds, walks, driveways and
<br />all lands belonging to "Rectors and Visitors of the University of Virginia", a
<br />corporation, although embraced within the boundaries of the city of Charlottes-
<br />ville as described above to be excluded therefrom and to remain and continue in
<br />all respects and for all purposes a part of the county of Albemarle.
<br />(2) The City of Charlottesville doth hereby set forth the necessity for and the
<br />expediency of the proposed annexation, that is to say:
<br />(a) That said annexation will give better health, police, fire and zoning
<br />protection, and water, Sas, street and public school facilities in the annexed
<br />territory than the County in which it is located can provide for the property and
<br />residents of same.
<br />(b) That the present and prospective systems of public improvements of the
<br />City, such as the establishment of grades of streets and alleys, the plans of con-
<br />struction of sewers, culverts, drains, water and gas mains, as well as zoning, building
<br />and health regulations, may be designed, adjusted and made, so as to avoid unnecessary
<br />annoyance, damage and expense necessarily occurring, where property is developed and
<br />built upon before such systems, plans and regulations are designated, acquired and made.
<br />(c) That a large part of the territory proposed to be annexed, though already
<br />built upon and occupied by residents, is without any sufficient system of sewers, or
<br />other improvements which ma'es it not only expedient but necessary that some complete
<br />system of sewerage be promptly designed and provided for the proper sanitation and im-
<br />provement of said territory at the earliest practical date.
<br />(d) That within the territory proposed to be annexed, there are several
<br />sections where houses and property are more or less dense, which necessitate. better
<br />police and fire protection than the County of Albemarle is enabled, with the means at
<br />its command, to afford such persons and properties and as a result, said conditions
<br />endanger t_ze safety of life and property not only without but also within the corporate
<br />limits.
<br />(e) That a large part of the territory proposed to be annexed is subdivided
<br />into building lots, is thickly populated and empties its sewerage either through
<br />privately owned systems, cess pools, seepage, drainage or otherwise, all of which
<br />constitutes a menace to the health of the people of the City of Charlottesville, and the
<br />inhabitants of the territory proposed to be annexed.
<br />(f) That there have been for a number of years past, suburban development and
<br />subdivision of property into lots and a number of sections of the territory proposed to
<br />be annexed, which lie just outside of the City of Ch«rlottesville and in the line of its
<br />inevitable growth, which sections must of necessity become a physical part of said City
<br />in the near future; that the City has contributed to this development by extending its
<br />municipal systems, services and activities into said proposed territory, and because of
<br />these developments, it is highly expedient and essential, if not absolutely necessary,
<br />that the sewerage, drainage, water supply, police, fire protection and streets of these
<br />sections should constitute one comprehensive system, and their future development be
<br />planned on one comprehensive scale, to the end that the people of both the City and annexed
<br />territory will be saved the loss and waste necessitated by the abandonment and replacement
<br />of inadequate and unrelated improvements which have been and are being constructed in the
<br />development of property* within the annexed territory, said improvements being suitable only
<br />to each development or subdivision and not beinb m.,'de with reference to the future con-
<br />solidation and needs of the entire annexed territory.
